【摘要】：伴隨著經(jīng)濟(jì)的快速發(fā)展以及高度的網(wǎng)絡(luò)化,未成年人犯罪問題也隨著經(jīng)濟(jì)和網(wǎng)絡(luò)帶來的負(fù)面影響越來越突出,并有逐年惡化的趨勢。近年來未成年人犯罪呈現(xiàn)出低齡化、暴力化、團(tuán)伙化的特征,這種情況的出現(xiàn)一是與家庭疏于教育有著很大的關(guān)聯(lián),二是受社會發(fā)展的負(fù)面影響,再者是對法律的錯誤理解所導(dǎo)致。我國對于未成年人承擔(dān)刑事責(zé)任強(qiáng)調(diào)“挽救為主、懲罰為輔”的方針,這一點(diǎn)在有關(guān)法律條文以及司法解釋中足可以體現(xiàn)出來。隨著未成年人犯罪的加劇,我國對關(guān)于未成年人刑事責(zé)任立法和政策都作出了不斷的變更和完善,然而關(guān)于未成年人的“教育挽救為主”刑事政策卻一直沿用至今,足可以看出我國對未成年人的保護(hù)力度。隨著社會的變革,我國關(guān)于未成年人刑事政策在實(shí)踐過程中所呈現(xiàn)的問題也越來越明顯,我國因缺少對于未成年人犯罪專門的立法導(dǎo)致實(shí)踐中產(chǎn)生的一系列矛盾也逐漸凸顯出來。本文以未成年人承擔(dān)刑事責(zé)任問題為出發(fā)點(diǎn),通過典型案例的引入,分析我國未成年人犯罪加劇的原因,找出我國關(guān)于未成年人承擔(dān)刑事責(zé)任存在的缺陷,如承擔(dān)刑事責(zé)任年齡問題、對未成年人的刑罰適用缺陷、刑種的缺陷等。結(jié)合我國基本國情以及借鑒域外關(guān)于未成年人承擔(dān)刑事責(zé)任的良好制度,針對所發(fā)現(xiàn)的問題,從刑事責(zé)任年齡、刑罰與刑種三個方面提出完善我國未成年人刑事責(zé)任的建議。
[Abstract]:With the rapid development of economy and the high degree of networking, the problem of juvenile delinquency becomes more and more prominent with the negative influence of economy and network, and has the tendency of worsening year by year. In recent years, juvenile delinquency has taken on the characteristics of younger age, violence and gang. The emergence of this situation is closely related to family neglect of education, and is negatively affected by social development. Moreover, the wrong understanding of the law is the result. Our country emphasizes the principle of "saving first, punishment secondary" for minors to bear criminal responsibility, which can be reflected in the relevant legal provisions and judicial interpretation. With the aggravation of juvenile delinquency, the legislation and policy on juvenile criminal responsibility have been constantly changed and perfected in our country. However, the criminal policy of "education and rescue" for minors has been used up to now. Enough to see our protection of minors. With the change of society, the problems in the practice of juvenile criminal policy in China are becoming more and more obvious. Due to the lack of special legislation for juvenile delinquency, a series of contradictions have emerged in practice in our country. Based on the criminal responsibility of minors, this paper analyzes the causes of the aggravation of juvenile delinquency in China through the introduction of typical cases, and finds out the defects existing in the criminal responsibility of minors in our country. Such as the age of criminal responsibility, the application of juvenile penalties defects, such as the defects of the type of punishment. Combined with the basic situation of our country and drawing lessons from the good system of criminal responsibility of minors outside China, this paper puts forward some suggestions on how to perfect the criminal responsibility of minors in our country from three aspects: age of criminal responsibility, penalty and type of punishment.
