【摘要】：誠(chéng)實(shí)信用原則是現(xiàn)實(shí)社會(huì)中占有統(tǒng)治地位的法律原則,而網(wǎng)絡(luò)社會(huì)中對(duì)于誠(chéng)信原則的需求更為必要和迫切。我國(guó)互聯(lián)網(wǎng)秩序當(dāng)前存在的諸多問題,其產(chǎn)生的重要原因在于重視政府對(duì)互聯(lián)網(wǎng)的單方面監(jiān)管,忽視調(diào)動(dòng)所有網(wǎng)絡(luò)參與者的積極性。我國(guó)互聯(lián)網(wǎng)治理在理念上應(yīng)該從網(wǎng)絡(luò)監(jiān)管到網(wǎng)絡(luò)治理的轉(zhuǎn)變,這個(gè)轉(zhuǎn)變是以誠(chéng)實(shí)信用原則為核心的,在具體路徑上應(yīng)該明確將誠(chéng)實(shí)信用作為我國(guó)互聯(lián)網(wǎng)統(tǒng)一立法的基本原則,并且從主管機(jī)關(guān)、網(wǎng)絡(luò)行業(yè)及網(wǎng)民三個(gè)方面制定相應(yīng)的具體措施,以確保誠(chéng)信原則的核心地位在網(wǎng)絡(luò)空間得以貫徹和實(shí)施。
[Abstract]:The principle of good faith is the dominant legal principle in the real society, and the demand for the principle of good faith is more necessary and urgent in the network society. There are many problems existing in the Internet order in our country. The important reason is that the government pays attention to the unilateral supervision of the Internet and neglects to arouse the enthusiasm of all the network participants. The concept of Internet governance in China should be changed from network supervision to network governance, which is based on the principle of honesty and credit, and should be clearly regarded as the basic principle of unified legislation of Internet in China in the specific path. In order to ensure that the core position of the principle of good faith can be carried out and implemented in cyberspace, the relevant concrete measures are made from three aspects: the competent authority, the network industry and the Internet users.
