【摘要】：全球公域是指處于國(guó)家主權(quán)管轄范圍以外的區(qū)域及其資源。全球公域這一概念本身內(nèi)涵著某種超越國(guó)家主權(quán)的規(guī)范。其公有屬性意味著對(duì)國(guó)家權(quán)力和利益的限制,而開(kāi)放性和資源的競(jìng)爭(zhēng)性則造成國(guó)家間在全球公域進(jìn)行博弈以獲取更多利益的現(xiàn)實(shí),兩者之間互相矛盾,這也是全球公域治理的倫理困境所在,即在全球公利與國(guó)家私利之間如何平衡的問(wèn)題。全球公域中存在著理性邏輯和實(shí)踐邏輯,這兩種行為邏輯互相制約,加上全球公域的公有屬性,使得國(guó)家權(quán)力在全球公域具有邊界性,利益的最大化受到制約。為了有效維護(hù)全球公域的公有屬性,需要加強(qiáng)制度建設(shè)以規(guī)范國(guó)家行為。本文對(duì)現(xiàn)有全球公域治理制度面臨的問(wèn)題和挑戰(zhàn)也進(jìn)行了分析,指出全球公域的治理制度亟待完善。中國(guó)歷來(lái)積極參與全球公域治理,可以從價(jià)值理念、制度建設(shè)等層面提供公共產(chǎn)品,以推動(dòng)全球公域秩序朝著更為公正合理的方向發(fā)展。
[Abstract]:The global Commons refer to areas and resources beyond the jurisdiction of national sovereignty. The concept of global Commons itself implies a norm that transcends national sovereignty. The public attribute means the restriction of the state power and interests, while the openness and the competition of resources lead to the reality that countries play games in the global Commons to gain more benefits, and the two conflicts with each other. This is also the ethical dilemma of global public governance, that is, how to balance the global public interest with the national private interest. There are rational logic and practical logic in the global common domain. These two kinds of behavioral logic restrict each other, together with the public attribute of the global common domain, which makes the state power have the boundary in the global common domain, and the maximization of the benefits is restricted. In order to effectively maintain the public attributes of the global Commons, it is necessary to strengthen the institutional construction to regulate state behavior. This paper also analyzes the problems and challenges faced by the existing global Commons governance system, and points out that the governance system of the global Commons needs to be improved urgently. China has always actively participated in the governance of the global Commons, which can provide public goods from the aspects of value concept, system construction and so on, in order to promote the development of the global public domain order towards a more just and reasonable direction.
