臺灣地區(qū)公私協(xié)力模式下政府責(zé)任分析

【摘要】:行政任務(wù)的行使,原則上應(yīng)由政府自行為之,非有法令依據(jù),不應(yīng)任意交由私部門行使。其用意,不外乎在于避免政府不當(dāng)轉(zhuǎn)嫁其責(zé)任,從而規(guī)避公法規(guī)范的約束。故臺灣地區(qū)公私協(xié)力的熱潮,引起了法學(xué)界,尤其是公法學(xué)界對政府責(zé)任承擔(dān)的擔(dān)憂。本文即通過對臺灣學(xué)術(shù)研究成果的系統(tǒng)梳理,分析目前臺灣公私協(xié)力模式下政府承擔(dān)責(zé)任的范圍。在公私協(xié)力模式下,很重要的議題是政府責(zé)任的分擔(dān)或共同承擔(dān)的問題。為分析臺灣地區(qū)公私協(xié)力模式下政府承擔(dān)的責(zé)任范圍,本文首先介紹臺灣地區(qū)公私協(xié)力模式的概況,包括起因,法律與政策的發(fā)展歷程,基本含義以及適用的范圍與方式,為后文研究提供基礎(chǔ)概念。其次,通過分析不同責(zé)任類型,來確定公私協(xié)力模式下政府所應(yīng)承擔(dān)的責(zé)任,即由“給付責(zé)任”轉(zhuǎn)向“擔(dān)保責(zé)任”。進(jìn)而分析政府承擔(dān)“擔(dān)保責(zé)任”的“憲法”依據(jù)及法理支撐。再次,“擔(dān)保責(zé)任”的范圍大體上可由法律上的規(guī)定和契約中的約定加以限定,通過梳理學(xué)術(shù)成果及實務(wù)中的做法來歸納政府“擔(dān)保責(zé)任”可能的范圍。最后,因臺灣公私協(xié)力模式涉及問題層面廣泛,個案差異較大,政府責(zé)任承擔(dān)范圍尚無統(tǒng)一的法律法規(guī)可以遵循,造成了實務(wù)中的困境。故在學(xué)術(shù)界已有學(xué)者開始探討建立一部統(tǒng)一適用的“擔(dān)保行政法”,從而規(guī)范與界定政府責(zé)任的范圍。因大陸學(xué)術(shù)界對臺灣此一制度尚未有系統(tǒng)性描述,故本文通過介紹臺灣公私協(xié)力模式下的政府責(zé)任,希望能為大陸學(xué)者進(jìn)行相關(guān)研究提供一絲幫助。
[Abstract]:The exercise of administrative tasks should, in principle, be carried out by the government on its own, not on the basis of a decree, but not arbitrarily by the private sector. The intention is to avoid the government passing on its responsibility and avoid the restriction of public law. Therefore, the upsurge of public-private cooperation in Taiwan has aroused the concern of the legal circles, especially the public law circles, about the responsibility of the government. This paper analyzes the scope of the government's responsibility under the public-private cooperation model in Taiwan through the systematic analysis of the academic research achievements in Taiwan. In the model of public-private cooperation, the important issue is the sharing or sharing of government responsibility. In order to analyze the scope of the government's responsibility under the public-private cooperation model in Taiwan, this paper first introduces the general situation of the public-private cooperation model in Taiwan, including the causes, the development course of law and policy, the basic meaning and the scope and method of application. To provide basic concepts for later studies. Secondly, through the analysis of different types of liability, the responsibility of the government should be determined under the model of public-private cooperation, that is, from "pay responsibility" to "guarantee responsibility". Then it analyzes the constitutional basis and legal support for the government to bear the "guarantee responsibility". Thirdly, the scope of "guarantee liability" can be limited by the legal provisions and the agreement in the contract, and the possible scope of the government's "guarantee liability" can be summed up by combing the academic achievements and the practice in practice. Finally, due to the wide range of problems involved in the public-private cooperation model in Taiwan and the large differences in individual cases, there are no uniform laws and regulations to be followed in the scope of government responsibility, resulting in difficulties in practice. Therefore, scholars in academic circles have begun to explore the establishment of a unified application of "guarantee administrative law", so as to regulate and define the scope of government responsibility. Since there is no systematic description of this system in mainland China, this paper, by introducing the responsibility of the government under the model of public-private cooperation in Taiwan, hopes to provide a little help for the relevant research of mainland scholars.
