【摘要】：民國時期廣西村民自治制度與當(dāng)代的村民自治制度有所區(qū)別。當(dāng)代的村民自治制度是在黨中央的統(tǒng)一領(lǐng)導(dǎo)下、在《憲法》、《村民委員會組織法》等法律的規(guī)制下進(jìn)行的,有明確的自治組織、完整的自治體系的自我管理、自我服務(wù)的自治制度。而在民國時期,由于歷史、文化、經(jīng)濟(jì)等的差異,當(dāng)時的村民自治則較為側(cè)重于村內(nèi)的自我發(fā)展。相比于當(dāng)代的,則是受到中央控權(quán)更小、法律約束更少。民國時期廣西村民自治制度基本內(nèi)容,與同時期其他省市的自治內(nèi)容相比,也較為完整。包括發(fā)展了村民自治組織和村民自治機(jī)構(gòu),并且進(jìn)行了村民民主選舉,創(chuàng)制了村民自治鄉(xiāng)規(guī)民約,完善了村民糾紛解決方式。從這一系列的村民自治內(nèi)容,我們看到的不僅是民國時期廣西村民自治制度的發(fā)展,更多的是我們可以借鑒的經(jīng)驗(yàn)和教訓(xùn)。廣西村民自治制度并沒有取得很好成果,最重要的一個原因是村民的民主權(quán)利、村民自治沒有以法律的形式固定下來,并且在該制度施行的過程中,缺乏相應(yīng)的監(jiān)督體系和程序。筆者認(rèn)為,從法史的角度看待當(dāng)代的法律制度,能夠掌握更全面的內(nèi)容;從法制本土化的角度分析當(dāng)代法律制度,能更清晰、深入的探究。從這些角度對當(dāng)代村民自治制度進(jìn)行梳理和分析,找出合理解決當(dāng)前村民糾紛多發(fā)的途徑,真正發(fā)揮村民自治制度發(fā)展民主的作用。本文共分為三章:第一章主要從理論層面分析民國時期村民自治制度的內(nèi)涵和內(nèi)容,為下文的評價(jià)和借鑒作鋪墊。第二章對民國時期村民自治制度作了正反面的綜合評價(jià)。從法律特征分析、與外省村民自治比較、案例解析等方面總結(jié)其精華和糟粕。第三章論及民國時期村民自治制度對當(dāng)代村民自治制度的借鑒意義。本文對當(dāng)代村民自治制度的困境現(xiàn)象集中于村民糾紛解決上,因此從村民糾紛的成因、影響因素等方面分析現(xiàn)存問題,并也就如何妥善解決村民糾紛提出了若干建議。
[Abstract]:In the period of the Republic of China, the system of villager autonomy in Guangxi was different from that of the contemporary villager autonomy system. Under the unified leadership of the Central Committee of the party, the present system of villager autonomy was carried out under the regulations of the constitution > the villagers Committee Organization Law and so on. There are clear autonomous organizations, self management system of self governance and self-service system of self service. In the period of the Republic of China, the villagers' autonomy was more focused on the self-development in the village because of the differences in history, culture and economy. Compared with the contemporary, the central control power was smaller and the legal constraints were less. The basic content of the villager autonomy system in Guangxi during the period of the Republic of China, compared with the autonomy of other provinces and cities at the same time, was also more complete. The villagers' self-government organizations and villagers' autonomous institutions have been developed, and the villagers' democratic elections have been carried out, the villagers' autonomous Township rules and regulations have been created, and the villagers' dispute settlement methods have been perfected. From this series of villagers' autonomy, we see not only the development of the self-governing system of villagers in Guangxi during the Republic of China, but more of which we can draw on. Experience and lessons. The villager autonomy system in Guangxi has not achieved good results. One of the most important reasons is the villagers' democratic rights. The villagers' autonomy is not fixed in the form of law. And in the process of the implementation of the system, the corresponding supervision system and procedures are lacking. It can be more comprehensive and more comprehensive; the analysis of the contemporary legal system from the point of view of the localization of the legal system can be clearer and deeply explored. From these angles, the present system of villagers' autonomy is combed and analyzed in order to find out the ways to solve the multiple problems of the Current Villagers' disputes, and to give full play to the democratic function of the village people's autonomy system. This paper is divided into three. Chapter one: the first chapter mainly analyzes the connotation and content of the villager autonomy system in the period of the Republic of China from the theoretical level, and pave the way for the evaluation and reference of the following. The second chapter makes a comprehensive evaluation on the villager autonomy system in the period of the Republic of China. The three chapter discusses the significance of the villagers' autonomy system in the period of the Republic of China to the contemporary villagers' autonomy system. This paper focuses on the settlement of the villagers' autonomy system, and therefore analyzes the existing problems from the causes of the villagers' disputes and the factors affecting the villagers' disputes, and puts forward some suggestions on how to properly solve the villagers' disputes.
