【摘要】：由社會(huì)力量擔(dān)任少年刑事司法社會(huì)調(diào)查的實(shí)施主體是我國(guó)少年刑事司法社會(huì)調(diào)查制度實(shí)施主體改革的鮮明特色之一。大學(xué)生具有專業(yè)文化知識(shí)和正確的人生價(jià)值觀,利用學(xué)生共青團(tuán)平臺(tái)、志愿者協(xié)會(huì)組織、社會(huì)工作組織,以志愿者、社工、準(zhǔn)法律人身份參與到未成年人社會(huì)調(diào)查工作中,體現(xiàn)“教育、感化、挽救”的司法保護(hù)精神,協(xié)助司法機(jī)關(guān)對(duì)涉案未成年人在偵查階段、審前階段、矯正階段、回歸階段等發(fā)揮“同伴教育”作用,促進(jìn)社會(huì)調(diào)查工作專業(yè)化、規(guī)范化,為社會(huì)調(diào)查報(bào)告詳實(shí)和客觀提供了技術(shù)保障,是推動(dòng)社會(huì)調(diào)查員制度建立和發(fā)展的有效路徑。本篇文章分為五部分,第一部分介紹本人選題的背景,研究?jī)?nèi)容、目的和意義,并分析國(guó)內(nèi)外研究的現(xiàn)狀。第二部分概述我國(guó)未成年人社會(huì)調(diào)查的含義及其功能,介紹我國(guó)社會(huì)調(diào)查主體成分以及現(xiàn)狀,以及分析大學(xué)生參與未成年人社會(huì)調(diào)查的可行性。第三部分介紹我國(guó)各地區(qū)大學(xué)生參與未成年人社會(huì)調(diào)查的探索,并列出大學(xué)生參與未成年人社會(huì)調(diào)查的各種優(yōu)勢(shì)。第四部分就是根據(jù)國(guó)內(nèi)外大學(xué)生參與未成年人社會(huì)調(diào)查的比較,總結(jié)大學(xué)生參與未成年人社會(huì)調(diào)查過(guò)程中容易產(chǎn)生的四點(diǎn)問(wèn)題。最后一部分就是提出可以解決上述四個(gè)問(wèn)題的四個(gè)建議,以完善大學(xué)生參與未成年人社會(huì)調(diào)查的工作。
[Abstract]:It is one of the distinct characteristics of the reform of the social investigation system of juvenile criminal justice in our country that the social investigation of juvenile criminal justice should be carried out by social forces. College students with professional cultural knowledge and correct values of life, using the platform of the Communist Youth League of students, volunteer association organizations, social work organizations, as volunteers, social workers, quasi-legal people to participate in the social investigation of minors, To embody the spirit of judicial protection of "education, probation and rescue", to assist the judicial organs in giving play to the role of "peer education" in the investigation, pre-trial, correction and return stages of minors involved in the case, and to promote the specialization of social investigation work. Standardization provides technical guarantee for detailed and objective social investigation report and is an effective way to promote the establishment and development of social investigator system. This article is divided into five parts. The first part introduces the background, research content, purpose and significance, and analyzes the current situation of domestic and foreign research. The second part summarizes the meaning and function of the social investigation of minors in our country, introduces the main components of the social investigation in China and the present situation, and analyzes the feasibility of college students participating in the social investigation of minors. The third part introduces the exploration of college students' participation in minor social investigation in various regions of our country, and lists the advantages of college students' participation in minor social investigation. The fourth part is according to the domestic and foreign university student to participate in the minor society investigation comparison, summarizes the university student to participate in the minor society investigation process easy to produce four questions. The last part is to put forward four suggestions to solve the above four problems in order to improve the participation of college students in the work of social investigation of minors.
