【摘要】：思想市場是指意見表達、觀點交換的場所或機制,其本質(zhì)上是一個公共論壇,沙龍、咖啡館等是早期表現(xiàn)形式,現(xiàn)代大眾傳媒出現(xiàn)以后,報紙、期刊、廣播、電視等成為其另一種表現(xiàn)形式。網(wǎng)絡思想市場則是以互聯(lián)網(wǎng)為平臺的思想市場,其觀點的自由競爭往往容易演變?yōu)閷ρ哉撟杂傻臑E用并造成對其他法益的侵害,這是網(wǎng)絡思想市場失靈的一種表現(xiàn)——負外部性。為此,國家通過法律規(guī)制使造成負外部性的責任主體承擔相應的法律責任,以避免這種負外部性的發(fā)生。
[Abstract]:The ideological market refers to the place or mechanism of expression and exchange of views, which is essentially a public forum, salons, cafes, and so on. After the emergence of the modern mass media, newspapers, periodicals, and radio broadcasts,Television, etc., has become another form of expression.The network thought market is the thought market with the Internet as the platform, and the free competition of its viewpoint is easy to evolve into the abuse of the freedom of expression and the infringement of other legal interests.This is a manifestation of network ideology market failure-negative externalities.In order to avoid the negative externality, the state makes the responsible subject bear the corresponding legal responsibility through legal regulation.
