【摘要】：隨著我國(guó)綜合國(guó)力和經(jīng)濟(jì)實(shí)力的增強(qiáng),在海外的中國(guó)公民人數(shù)不斷的增加。從改革開放到加入世貿(mào)組織,再到“一帶一路”,中國(guó)走出去的步伐不斷地加快和深入。但現(xiàn)在全球安全局勢(shì)復(fù)雜,中國(guó)要想安全的走出去,要想中國(guó)的公民安全的行走在世界的每一個(gè)角落,就必須加快發(fā)展領(lǐng)事保護(hù)�，F(xiàn)階段關(guān)于領(lǐng)事保護(hù)的研究已經(jīng)開始鋪展開來(lái),但這一領(lǐng)域在國(guó)內(nèi)而言還尚屬于一個(gè)較為嶄新的領(lǐng)域。加快對(duì)這一問(wèn)題的研究將會(huì)對(duì)中國(guó)未來(lái)成為全球性有影響力大國(guó)的目標(biāo)形成保障。首先,本文從領(lǐng)事保護(hù)制度的研究開始,通過(guò)探究領(lǐng)事保護(hù)制度的歷史發(fā)展,特別是國(guó)際法和國(guó)際制度中關(guān)于領(lǐng)事保護(hù)的界定,為更精確地定義領(lǐng)事保護(hù)奠定前提。接下來(lái)通過(guò)研究目前美國(guó)、英國(guó)、中國(guó)等國(guó)家官方文本、材料中提及的關(guān)于領(lǐng)事保護(hù)的相關(guān)規(guī)定,為本文對(duì)領(lǐng)事保護(hù)概念的界定提供更加廣闊的坐標(biāo)軸。在上述研究的基礎(chǔ)上,結(jié)合各國(guó)學(xué)者的諸多觀點(diǎn)帶來(lái)的啟發(fā)以及本文作者的個(gè)人思考,抽象出領(lǐng)事保護(hù)的概念。其次,從歷史研究的角度探討中國(guó)領(lǐng)事保護(hù)發(fā)展的三個(gè)階段及其發(fā)展的原因分析,為更深層次的探討中國(guó)領(lǐng)事保護(hù)發(fā)展的影響因子和發(fā)展路徑提供歷史經(jīng)驗(yàn)。從新中國(guó)成為初期到1978年是中國(guó)海外公民領(lǐng)事保護(hù)從逐漸展開到陷入停滯的階段。從1978年改革開放到2004年,中國(guó)海外公民領(lǐng)事保護(hù)從停滯進(jìn)入了快速發(fā)展的階段。這主要表現(xiàn)在領(lǐng)事保護(hù)條約的簽署、國(guó)內(nèi)法制的完善、領(lǐng)事機(jī)構(gòu)的健全等方面。2004年之后,中國(guó)海外公民的領(lǐng)事保護(hù)進(jìn)入了新的發(fā)展階段。再次,主要討論了結(jié)合現(xiàn)階段的領(lǐng)事保護(hù)發(fā)展?fàn)顩r,提出當(dāng)前中國(guó)海外公民領(lǐng)事保護(hù)發(fā)展存在的問(wèn)題和不足。第四章則是針對(duì)當(dāng)前中國(guó)海外公民領(lǐng)事保護(hù)中存在的問(wèn)題,借鑒各國(guó)領(lǐng)事保護(hù)發(fā)展的方式方法和作者的個(gè)人思考,對(duì)我國(guó)的領(lǐng)事保護(hù)的發(fā)展提出解決辦法。
[Abstract]:With the strengthening of China's comprehensive national strength and economic strength, the number of Chinese citizens abroad is constantly increasing. From the reform and opening up to the accession to the World Trade Organization, To Belt and Road, the pace of China's going out has been accelerating and deepening. But now the global security situation is complex. If China wants to go out safely, it wants its citizens to walk safely in every corner of the world. We must speed up the development of consular protection. At this stage, the research on consular protection has begun to spread out. However, this field is still a relatively new one at home. Speeding up research on this issue will guarantee China's goal of becoming a global and influential power in the future. First of all, Starting from the study of consular protection system, this paper explores the historical development of consular protection system, especially the definition of consular protection in international law and international system. To lay the groundwork for a more precise definition of consular protection. Next, by studying the relevant provisions on consular protection currently mentioned in the official texts of the United States, the United Kingdom, China, and other countries, It provides a broader coordinate axis for the definition of the concept of consular protection in this paper. On the basis of the above research, combined with the inspiration of scholars from various countries and the personal thinking of the author of this article, the concept of consular protection is abstracted. Secondly, From the perspective of historical research, this paper probes into the three stages of the development of consular protection in China and the reasons for its development. From the beginning of the new China to 1978, the consular protection of overseas citizens of China gradually expanded to a stage of stagnation. From 1978 to 2004, The consular protection of Chinese overseas citizens has entered a stage of rapid development from stagnation. This is mainly manifested in the signing of consular protection treaties, the perfection of domestic legal system, the integrity of consular institutions, and so on. After 2004, The consular protection of Chinese overseas citizens has entered a new stage of development. Thirdly, the development of consular protection at this stage is mainly discussed. The fourth chapter aims at the problems existing in the development of consular protection of Chinese overseas citizens, and draws lessons from the ways and methods of consular protection development in various countries and the author's personal thinking. To our country's consular protection development proposed the solution.
