【摘要】：正 一、“有組織犯罪猖獗,黑社會復(fù)活了!” 一般認(rèn)為,目前我國有組織犯罪的犯罪形態(tài)符合黑社會的一些特征,但只是具有黑社會性質(zhì)的組織,還不是典型的黑社會組織。然而,根據(jù)2000年歲末“掃黑除惡”專項斗爭破獲出來的案件看和當(dāng)前中國大陸有組織犯罪的最新動態(tài)看,有的有組織犯罪的行為,已經(jīng)完全符合黑社會組織的基本特征。如果將這類犯罪還認(rèn)定為“黑社會性質(zhì)組織罪”,已經(jīng)不符合當(dāng)前的實際。因為黑社會組織一般有
