我國(guó)基層公安機(jī)關(guān)面臨的問(wèn)題及對(duì)策研究

【摘要】：我國(guó)的基層公安機(jī)關(guān)是指依法建立的承擔(dān)維護(hù)國(guó)家安全、維護(hù)社會(huì)治安秩序、保護(hù)公民的人身安全、人身自由和合法財(cái)產(chǎn)、保護(hù)公共財(cái)產(chǎn)，預(yù)防制止和懲治犯罪活動(dòng)職能和任務(wù)的國(guó)家基層行政機(jī)關(guān)。是基層人民警察機(jī)關(guān)。是我國(guó)人民民主專(zhuān)政政權(quán)中具有武裝性質(zhì)的治安行政和刑事司法的基層機(jī)關(guān)。它具有民主與專(zhuān)政兩項(xiàng)基本職能。從這個(gè)基層公安機(jī)關(guān)的概念中我們可以看到，我國(guó)基層公安機(jī)關(guān)是我國(guó)人民民主專(zhuān)政的重要工具之一，是國(guó)家政權(quán)的重要組成部分；是武裝性質(zhì)的國(guó)家治安行政力量�；鶎庸矙C(jī)關(guān)本身的屬性決定了基層公安機(jī)關(guān)在新的歷史時(shí)期應(yīng)承擔(dān)重大的歷史責(zé)任，發(fā)揮重大的歷史作用：保衛(wèi)社會(huì)主義制度；維護(hù)社會(huì)治安和公共秩序，確保社會(huì)穩(wěn)定；保護(hù)國(guó)家公共財(cái)產(chǎn)和人民的合法財(cái)產(chǎn)；保護(hù)公民的人身自由和安全；保障依法治國(guó)方略的落實(shí)。 回顧基層公安機(jī)關(guān)曾經(jīng)走過(guò)的歷程，我們不難看到，基層公安機(jī)關(guān)為新中國(guó)建立和建設(shè)做出了巨大貢獻(xiàn)。改革開(kāi)放以后，我國(guó)基層公安機(jī)關(guān)迅速發(fā)展，隊(duì)伍不斷壯大，人數(shù)不斷增多�，F(xiàn)在，隨著中國(guó)改革開(kāi)放的深入和中國(guó)市場(chǎng)經(jīng)濟(jì)體制的逐步確立，我國(guó)基層公安機(jī)關(guān)在隊(duì)伍建設(shè)方面暴露出了許多問(wèn)題，其主要問(wèn)題是；違法違紀(jì)現(xiàn)象嚴(yán)重；干警總體素質(zhì)不高；公安管理職權(quán)范圍界定不清；執(zhí)法保障不力。這些問(wèn)題的存在已嚴(yán)重地影響了基層公安隊(duì)伍的革命化、正規(guī)化、現(xiàn)代化、軍事化建設(shè)；影響了黨和政府各項(xiàng)方針，政策的落實(shí)；影響了社會(huì)主義現(xiàn)代化建設(shè)。如果我們聽(tīng)任這些問(wèn)題發(fā)展蔓延，不管不問(wèn)，就會(huì)破壞基層公安工作賴(lài)以生存的警民關(guān)系，毀壞公安戰(zhàn)線廣大民警用鮮血和生命贏得的榮譽(yù)，從而損害黨和政府在人民群眾中的形象，最終毀掉整個(gè)公安隊(duì)伍，危害到國(guó)家政權(quán)。 我國(guó)基層公安機(jī)關(guān)出現(xiàn)以上問(wèn)題的原因主要是：教育滯后；監(jiān)督不力；人事管理制度不完善；管理體制不夠完善；地方財(cái)政保證不力。在找出基層公安 ／Hh （’～一一” ＼、．＿。－＿＿ ＼／。�！� 機(jī)關(guān)出現(xiàn)問(wèn)題的原因并加以剖析時(shí)，我們可以發(fā)現(xiàn)，基層公安機(jī)關(guān)出現(xiàn)問(wèn)題的 原因，既有歷史的，也有現(xiàn)時(shí)的；既有主觀的，，也有客觀的。因此，我們?cè)谘?究制定相應(yīng)對(duì)策的時(shí)候，要著眼于基層公安機(jī)關(guān)的整體。要用發(fā)展的眼光， 實(shí)事求是的態(tài)度，深層次地看待問(wèn)題，力求根治。 依據(jù)基層公安機(jī)關(guān)所面臨的問(wèn)題找出原因不是目的，目的是根據(jù)原因制定 出根治對(duì)策，使基層公安機(jī)關(guān)從根本上擺脫不利因素，健康向前發(fā)展。就我國(guó) 基層公安機(jī)關(guān)現(xiàn)在所面臨的問(wèn)題，要從根本上解決，必須要按照以下幾個(gè)方面 去做：強(qiáng)化教育，提高素質(zhì)；進(jìn)一步理順公安機(jī)關(guān)的管理體制；健全與完善公 安機(jī)關(guān)的人事管理制度；加強(qiáng)基層公安機(jī)關(guān)的內(nèi)部監(jiān)督與外部監(jiān)督；努力改善 基層公安機(jī)關(guān)的保障系統(tǒng)。
