思想政治教育預(yù)防職務(wù)犯罪研究

【摘要】： 職務(wù)犯罪是指國家公職人員利用職務(wù)便利非法獲取額外的物質(zhì)或非物質(zhì)私利的行為。從本質(zhì)上看,它是人類社會(huì)發(fā)展到一定階段,社會(huì)公共權(quán)力異化的結(jié)果。20世紀(jì)90年代以來,職務(wù)犯罪已成為全世界最為關(guān)注的焦點(diǎn)問題,它如同社會(huì)溫疫一樣極大損害著社會(huì)正義、破壞著經(jīng)濟(jì)發(fā)展、腐蝕著政治清明,成為人類社會(huì)生活、經(jīng)濟(jì)生活、政治生活中的一顆毒瘤。因此,無論是發(fā)達(dá)國家還是發(fā)展中國家,雖然社會(huì)制度不同、經(jīng)濟(jì)發(fā)展各異、文化意識(shí)傳統(tǒng)有別,但都面臨著反職務(wù)犯罪的共同課題。 筆者以鄧小平理論和“三個(gè)代表”思想為理論指導(dǎo),以“構(gòu)建和諧社會(huì)”為戰(zhàn)略目標(biāo),緊密結(jié)合中國國情和改革實(shí)踐,遵循“預(yù)防是治本之策”、“教育是基礎(chǔ)”的反腐工作方針,展開了對(duì)思想政治教育預(yù)防職務(wù)犯罪問題的研究。在本文選題和研究的背后激蕩著筆者強(qiáng)烈的憂國憂民意識(shí),也結(jié)合了筆者復(fù)合的專業(yè)知識(shí)背景。筆者以交叉學(xué)科的研究方法分析職務(wù)犯罪形成的社會(huì)思想根源、尋求防治職務(wù)犯罪治本之策,為完善職務(wù)犯罪預(yù)防體系提出了新的內(nèi)容,具有一定的理論和實(shí)踐價(jià)值。筆者衷心期望本文的研究成果及研究方法能對(duì)我國預(yù)防職務(wù)犯罪理論研究和實(shí)踐工作提供有益的借鑒,為早日消除“社會(huì)的毒瘤”貢獻(xiàn)學(xué)子的綿薄之力。 本文共分為四個(gè)部分:第一部分首節(jié)敘述了職務(wù)犯罪的現(xiàn)狀,以觸目驚心的數(shù)字喚起人們對(duì)職務(wù)犯罪現(xiàn)象的社會(huì)危機(jī)意識(shí),加強(qiáng)對(duì)職務(wù)犯罪預(yù)防工作重視程度。次節(jié)評(píng)析了各國在職務(wù)犯罪的預(yù)防實(shí)踐中的成功經(jīng)驗(yàn),并提出了我國職務(wù)犯罪預(yù)防的戰(zhàn)略選擇和具體要求,即標(biāo)本兼治、教育為基。第二部分明晰了思想政治教育在職務(wù)犯罪中的價(jià)值,提出明確了思想政治教育是職務(wù)犯罪預(yù)防的基礎(chǔ)和中心環(huán)節(jié)。接著分析了思想政治教育預(yù)防職務(wù)犯罪的價(jià)值功能,為思想政治教育應(yīng)用于預(yù)防職務(wù)犯罪提供了理論依據(jù)。第三部分剖析了思想政治教育預(yù)防職務(wù)犯罪的實(shí)踐環(huán)境,即滋生職務(wù)犯罪的社會(huì)思想道德根源,為有針對(duì)性開展思想政治教育,理性設(shè)計(jì)教育系統(tǒng)提供了現(xiàn)實(shí)依據(jù)。第四部分首先對(duì)思想政治教育預(yù)防職務(wù)犯罪做了系統(tǒng)設(shè)計(jì),對(duì)教學(xué)目標(biāo)、教育內(nèi)容、教育形式作出科學(xué)設(shè)計(jì),主要包括從政治思想上去培養(yǎng)、用為官從政之道去教養(yǎng)、用倫理道德去修養(yǎng)、用法制觀念去調(diào)養(yǎng)、用樹立典型撫養(yǎng)、用批評(píng)教育去療養(yǎng)等方面。隨后指出思想政治教育預(yù)防職務(wù)犯罪要堅(jiān)持制度化、技術(shù)化和社會(huì)化的發(fā)展方向,全方位、多層次地形成縱橫交錯(cuò)的思想教育網(wǎng)絡(luò),在廣大公職人員和社會(huì)公眾的心靈深處產(chǎn)生潛移默化的效應(yīng),鞏固職務(wù)犯罪預(yù)防的思想基礎(chǔ),增強(qiáng)預(yù)防職務(wù)犯罪的實(shí)效性。
[Abstract]:Duty crime refers to the use of duty by public officials to facilitate the illegal acquisition of additional material or non-material self-interest. In essence, it is the result of the dissimilation of social public power and the development of human society. Since the 1990s, the crime of duty has become the focus of attention all over the world. As a social epidemic, it greatly damages social justice, destroys economic development, corrodes political clarity, and becomes a tumor in human social life, economic life and political life. Therefore, whether developed or developing countries, although the social system is different, economic development is different, cultural consciousness tradition is different, but all are facing the common subject of anti-duty crime. The author takes Deng Xiaoping Theory and the thought of "three represents" as the theoretical guidance, takes "constructing a harmonious society" as the strategic goal, closely combines China's national conditions and reform practice, and follows the "prevention is the fundamental policy". The anti-corruption policy of "Education is the basis" has carried out the research on the prevention of duty crime in ideological and political education. At the back of this thesis, the author has a strong sense of worrying about the country and the people, and also combined the author's complex professional knowledge background. In this paper, the author analyzes the social ideological roots of the formation of duty crime by means of cross-disciplinary research, seeks the prevention and cure measures of duty crime, and puts forward a new content for perfecting the prevention system of duty crime, which has certain theoretical and practical value. The author sincerely hopes that the research results and methods in this paper will provide a useful reference for the theoretical research and practical work on the prevention of duty crime in China, and contribute to the early elimination of the "tumor of the society". This paper is divided into four parts: the first section describes the status quo of duty crime, with shocking figures to arouse people's awareness of social crisis to the phenomenon of duty crime, and to strengthen the emphasis on the prevention of duty crime. The second section analyzes the successful experiences of various countries in the practice of duty crime prevention, and puts forward the strategic choice and specific requirements for the prevention of duty crime in China, that is, both the symptoms and the root causes, and education as the basis. The second part clarifies the value of ideological and political education in duty crime, and puts forward that ideological and political education is the foundation and central link of duty crime prevention. Then it analyzes the value and function of ideological and political education in preventing duty crime, which provides a theoretical basis for the application of ideological and political education in the prevention of duty crime. The third part analyzes the practical environment of preventing duty crime in ideological and political education, that is, the social ideological and moral root of duty crime, which provides the realistic basis for carrying out ideological and political education and rationally designing education system. The fourth part first makes a systematic design of ideological and political education to prevent duty crime, and makes a scientific design of teaching objectives, educational contents and forms of education, which mainly includes training from the political ideology and using the way of government for the official to cultivate the students, and make a scientific design of the teaching objectives, educational contents and forms of education. To cultivate with ethics, to cultivate with the concept of legal system, with the establishment of typical upbringing, with critical education to recuperate and so on. Then it is pointed out that ideological and political education should adhere to the development direction of institutionalization, technicalization and socialization, and form a crisscross network of ideological education in an all-round and multi-level manner. In the hearts and minds of public officials and the public have a subtle effect, consolidate the ideological basis of the prevention of duty crime, enhance the effectiveness of the prevention of duty crime.
