【摘要】：網(wǎng)絡(luò)犯罪是區(qū)別于傳統(tǒng)犯罪的新型犯罪類型,由于其犯罪手段的特殊性和巨大的社會(huì)危害性,引起了社會(huì)的廣泛關(guān)注。網(wǎng)絡(luò)犯罪已經(jīng)對(duì)社會(huì)構(gòu)成了現(xiàn)實(shí)的威脅,嚴(yán)重威脅因特網(wǎng)的生存與發(fā)展,直接影響國(guó)家政治、經(jīng)濟(jì)、文化等各方面的正常秩序,成為信息時(shí)代的最大隱患。探尋網(wǎng)絡(luò)犯罪的預(yù)防方法已成為網(wǎng)絡(luò)科技時(shí)代的歷史性課題。本文借鑒犯罪學(xué)、刑法學(xué)等學(xué)科的理論和方法,探討網(wǎng)絡(luò)犯罪的概念及罪名的認(rèn)定,分析網(wǎng)絡(luò)犯罪的顯著特征,闡述我國(guó)網(wǎng)絡(luò)犯罪的新動(dòng)向及防控現(xiàn)狀,并在此基礎(chǔ)上有針對(duì)性地提出相應(yīng)的預(yù)防對(duì)策,以其為司法機(jī)關(guān)及普通公眾認(rèn)識(shí)網(wǎng)絡(luò)犯罪、預(yù)防和打擊網(wǎng)絡(luò)犯罪提供一定的參考。本文從網(wǎng)絡(luò)倫理道德、網(wǎng)絡(luò)技術(shù)防范、網(wǎng)絡(luò)立法、加強(qiáng)網(wǎng)絡(luò)犯罪的社會(huì)預(yù)防和國(guó)際司法合作五個(gè)方面對(duì)網(wǎng)絡(luò)犯罪的預(yù)防進(jìn)行了深入的思考。試圖構(gòu)建以加強(qiáng)網(wǎng)絡(luò)精神文明建設(shè)為核心,以提高計(jì)算機(jī)網(wǎng)絡(luò)技術(shù)為手段,以建立和完善法律控制體系為保證,以加強(qiáng)國(guó)家對(duì)網(wǎng)絡(luò)的管理和個(gè)人的積極預(yù)防為方法,以加強(qiáng)國(guó)際司法合作為聯(lián)盟的立體預(yù)防網(wǎng)絡(luò)犯罪的體系。
[Abstract]:Network crime is a new type of crime, which is different from the traditional crime. Because of its particularity and great social harmfulness, it has attracted wide attention of the society. Network crime has posed a real threat to the society, seriously threatened the survival and development of the Internet, directly affected the national political, economic, cultural and other aspects of the normal order, become the biggest hidden danger in the information age. Exploring the prevention method of network crime has become a historic subject in the era of network science and technology. Using the theories and methods of criminology and criminal law for reference, this paper probes into the concept of network crime and the determination of its charges, analyzes the remarkable characteristics of network crime, and expounds the new trend and current situation of prevention and control of network crime in our country. On the basis of this, the corresponding preventive countermeasures are put forward in order to provide a certain reference for the judicial organs and the general public to understand the network crime and to prevent and crack down on the network crime. This paper makes a deep thinking on the prevention of network crime from five aspects: network ethics, network technology prevention, network legislation, strengthening social prevention of network crime and international judicial cooperation. In order to strengthen the network spiritual civilization construction as the core, to improve the computer network technology as the means, to establish and perfect the legal control system as the guarantee, to strengthen the national network management and personal active prevention as the method, To strengthen international judicial cooperation as the alliance of three-dimensional prevention of cybercrime system.
