【摘要】： 隨著我國(guó)經(jīng)濟(jì)建設(shè)和社會(huì)發(fā)展步伐的加快，各地的建筑行業(yè)得到了前所未有的發(fā)展。但是，，建筑工程領(lǐng)域紅火的同時(shí)也伴隨著職務(wù)犯罪的高發(fā)，選擇這樣一個(gè)課題進(jìn)行研究無(wú)疑具有現(xiàn)實(shí)意義。本文擬從犯罪學(xué)的角度，運(yùn)用行為經(jīng)濟(jì)原則等理論對(duì)建筑工程領(lǐng)域職務(wù)犯罪的特點(diǎn)、原因及其防治進(jìn)行分析，以期對(duì)控制該類(lèi)職務(wù)犯罪有所裨益。 結(jié)合有關(guān)的數(shù)據(jù)統(tǒng)計(jì)和具體案例進(jìn)行分析，建筑工程領(lǐng)域職務(wù)犯罪具有權(quán)錢(qián)交易普遍、犯罪金額趨大、犯罪手段多樣化、行規(guī)性、隱蔽性、共生性等特點(diǎn)，并往往伴隨著嚴(yán)重的工程質(zhì)量問(wèn)題；犯罪運(yùn)行主要存在于規(guī)劃設(shè)計(jì)環(huán)節(jié)、招標(biāo)投標(biāo)環(huán)節(jié)、材料采購(gòu)環(huán)節(jié)、施工環(huán)節(jié)、質(zhì)量監(jiān)督監(jiān)理環(huán)節(jié)、決算結(jié)算環(huán)節(jié)、留守環(huán)節(jié)等七個(gè)環(huán)節(jié)之中。究其原因，有行業(yè)競(jìng)爭(zhēng)激烈、私欲膨脹、缺少監(jiān)督、管理混亂、打擊不力等方面的因素。建筑工程領(lǐng)域職務(wù)犯罪的防治需要各部門(mén)齊抓共管，也應(yīng)該有很多種方法。本文著重就檢察機(jī)關(guān)如何發(fā)揮其預(yù)防和打擊的職能作用來(lái)控制建筑工程領(lǐng)域職務(wù)犯罪的蔓延進(jìn)行討論，同時(shí)還提出有必要進(jìn)一步完善立法，賦予檢察機(jī)關(guān)更多的職能和手段，通過(guò)對(duì)追訴職務(wù)犯罪進(jìn)行成本核算、提高檢察機(jī)關(guān)行使公益訴訟的可操作性、加重對(duì)巨額財(cái)產(chǎn)來(lái)源不明罪的量刑、引入證人的交易豁免等手段，更好地打擊職務(wù)犯罪。
[Abstract]:With the acceleration of economic construction and social development in China, the construction industry has been unprecedented development. However, with the high incidence of job-related crime in the field of construction engineering, it is undoubtedly of practical significance to choose such a subject to study. From the point of view of criminology, this paper analyzes the characteristics, causes and prevention of job-related crime in the field of construction engineering by using the theory of behavioral economy, so as to be of benefit to the control of this kind of job-related crime. According to the relevant data, statistics and specific cases, the crimes committed in the field of construction engineering are characterized by the widespread trading of power and money, the increasing amount of crime, the diversification of criminal means, the regularity of the industry, the concealment, the symbiosis, and so on. And often accompanied by serious engineering quality problems; Criminal operation mainly exists in seven links, such as planning and design, bidding and bidding, material purchasing, construction, quality supervision and supervision, final accounting and settlement, and staying behind. The reasons include fierce competition, lust expansion, lack of supervision, management confusion, weak crackdown and so on. The prevention and cure of duty crime in the field of construction engineering need all departments to work together, and there should be many methods. This paper focuses on how the procuratorial organs exert their functions of preventing and attacking to control the spread of job-related crimes in the field of construction engineering, and at the same time puts forward the need to further improve the legislation and endow the procuratorial organs with more functions and means. Through the cost accounting of the prosecution of duty crime, improving the maneuverability of procuratorial organs to exercise public interest litigation, increasing the sentencing of the crime of huge amount of property of unknown origin, introducing the transaction exemption of witnesses, and so on, we can better crack down on the duty crime.
