【摘要】： 近年來(lái),職務(wù)犯罪泛濫成災(zāi),普遍地存在于各種權(quán)力領(lǐng)域中,成為現(xiàn)代國(guó)家肌體中的“惡性腫瘤”,嚴(yán)重?fù)p害了政府的公信力、侵害了經(jīng)濟(jì)基礎(chǔ),敗壞了社會(huì)風(fēng)氣。但試圖完全消滅它是不可能的,也是不經(jīng)濟(jì)的,如何更有效地預(yù)防職務(wù)犯罪,如何更大程度地提高政府廉潔度和工作效率,如何更好地實(shí)現(xiàn)社會(huì)公平,是我們進(jìn)行職務(wù)犯罪研究的目標(biāo)。各國(guó)在職務(wù)犯罪預(yù)防的理論研究與實(shí)踐工作中開(kāi)始逐步關(guān)注和重視道德預(yù)防。作為一種以道德規(guī)范作為人的內(nèi)心力量,通過(guò)增強(qiáng)人們的道德意識(shí)來(lái)抵御腐朽思想的侵襲,最終達(dá)到預(yù)防犯罪目的的預(yù)防手段,道德預(yù)防具有法律預(yù)防所不可替代的作用:經(jīng)濟(jì)成本更低,預(yù)防效果更持久、更徹底。本文從分析我國(guó)公職人員的職業(yè)道德意識(shí)現(xiàn)狀入手,從職業(yè)道德建設(shè)、職業(yè)控制體系、社會(huì)監(jiān)督機(jī)制三個(gè)方面出發(fā),嘗試性地構(gòu)建我國(guó)職務(wù)犯罪的道德預(yù)防體系,希望一個(gè)高效的、廉潔的、無(wú)腐敗的政府能夠早日出現(xiàn)。
[Abstract]:In recent years, job-related crimes are widespread in various fields of power and become "malignant tumors" in the body of modern countries, which have seriously damaged the credibility of the government, infringed on the economic base, and damaged the social atmosphere. But it is impossible and uneconomical to try to eliminate it completely. How to prevent crime by duty more effectively, how to improve the government's cleanliness and work efficiency to a greater extent, how to realize social equity better, Is our duty crime research goal. In the theoretical research and practice of duty crime prevention, countries begin to pay attention to moral prevention step by step. As a means of preventing crime by strengthening people's moral consciousness to resist the invasion of decadent thoughts and to achieve the purpose of crime prevention, as a kind of moral norms as the inner strength of human beings, Moral prevention plays an irreplaceable role in legal prevention: lower economic cost, more lasting and more thorough preventive effect. Starting with the analysis of the present situation of the professional ethics consciousness of public officials in China, this paper tries to construct the moral prevention system of duty crime in our country from three aspects: the construction of professional ethics, the system of professional control, and the mechanism of social supervision. We hope that an efficient, clean and corrupt government will emerge as soon as possible.
