【摘要】： 經(jīng)過五十多年的風風雨雨,作為一種對犯有輕微違法行為且對社會有一定危害的公民進行人身自由限制的行政處罰,勞動教養(yǎng)制度在保障人民合法權(quán)益,維護社會治安穩(wěn)定等方面發(fā)揮了積極的作用,但與此同時,隨著社會不斷向前發(fā)展,人們的法律維權(quán)意識和人權(quán)概念的日益深化,勞動教養(yǎng)的一些內(nèi)部管理機制已經(jīng)不能適應(yīng)時代要求,如絕對的人身自由限制就被社會各界廣泛詬病,筆者通過總結(jié)國外社區(qū)矯治經(jīng)驗以及上海市一些社區(qū)矯治試點的成果,試圖用社區(qū)矯治的思路構(gòu)建一條勞動教養(yǎng)未來發(fā)展之路,其中引用的一些數(shù)據(jù)來自互聯(lián)網(wǎng)和相關(guān)雜志。 本論文的內(nèi)容結(jié)構(gòu)主要分為六章,第一章為緒論,第二章介紹了我國勞動教養(yǎng)制度以及當前管理模式的利弊,第三章論證勞動教養(yǎng)社區(qū)矯治的可行性,第四章介紹了上海社區(qū)矯治的實例并分析了相關(guān)數(shù)據(jù),第五章分析我國勞動教養(yǎng)社區(qū)化與歐美發(fā)達國家相比還有哪些差距,第六章對我國發(fā)展勞動教養(yǎng)社區(qū)矯治進行了理性思考,提出自己的構(gòu)想。
[Abstract]:After more than 50 years of ups and downs, as an administrative punishment that restricts the personal freedom of citizens who have committed minor illegal acts and are harmful to society, the system of re-education through labour is protecting the legitimate rights and interests of the people. The maintenance of social order and stability has played a positive role, but at the same time, with the continuous development of society, people's awareness of legal rights and the concept of human rights are deepening day by day. Some internal management mechanisms of reeducation through labor have been unable to meet the requirements of the times. For example, absolute restrictions on personal freedom have been widely criticized by all walks of life. The author summarizes the experience of community correction in foreign countries and the results of some community correction pilot projects in Shanghai. This paper attempts to construct a way for the future development of reeducation through labor with the idea of community correction. Some of the data cited are from the Internet and related magazines. The content structure of this thesis is divided into six chapters, the first chapter is the introduction, the second chapter introduces the advantages and disadvantages of our country's reeducation through labor system and the current management mode, the third chapter demonstrates the feasibility of community correction of reeducation through labor. The fourth chapter introduces the examples of community correction in Shanghai and analyzes the relevant data. Chapter five analyzes the gap between China's community of reeducation through labor and the developed countries in Europe and the United States. The sixth chapter makes rational thinking on the development of reeducation through labor community correction and puts forward its own idea.
