【摘要】：邏輯起點(diǎn)是學(xué)科建設(shè)的基礎(chǔ)理論問(wèn)題。在探討偵查學(xué)邏輯起點(diǎn)時(shí),從馬克思政治經(jīng)濟(jì)學(xué)以商品為其邏輯起點(diǎn)構(gòu)建學(xué)科的特征為依據(jù),將偵查學(xué)的邏輯起點(diǎn)置于法學(xué)大系統(tǒng)中研究,將法學(xué)邏輯起點(diǎn)定為行為,將偵查學(xué)與刑事法學(xué)作為同一系統(tǒng)分析,從而得出偵查學(xué)的“基因”內(nèi)核即其邏輯起點(diǎn)為犯罪行為。并從理論的層面上研究邏輯起點(diǎn)的特定的理論存在及其功能,力圖推動(dòng)偵查學(xué)的理論研究, 進(jìn)而發(fā)展偵查學(xué)的學(xué)科建設(shè)。
[Abstract]:The logical starting point is the basic theoretical problem of discipline construction. When discussing the starting point of the logic of investigation, according to the characteristics of the construction of the discipline based on commodity as the logical starting point of Marx's political economy, the logical starting point of the science of investigation is studied in the large system of law, and the starting point of logic of law is regarded as the behavior. This paper analyzes the same system between the criminal law and the criminal law, and concludes that the core of "gene" of the science of criminal investigation is criminal behavior. At the same time, the author studies the specific theoretical existence and function of the logic starting point from the theoretical level, and tries to promote the theoretical research of the science of investigation and then develop the subject construction of the science of investigation.
