【摘要】： 在我國(guó)當(dāng)前刑事偵查工作中,案件發(fā)現(xiàn)難、排查難、緝捕難、審訊難等對(duì)傳統(tǒng)偵查手段提出巨大挑戰(zhàn),除運(yùn)用DNA、信息技術(shù)等高科技手段外,我們還要加強(qiáng)對(duì)犯罪心理學(xué)在刑事偵查中的運(yùn)用研究。在刑事案件的現(xiàn)場(chǎng)勘查、偵緝抓捕和審訊深挖以及其他刑事偵查活動(dòng)中,犯罪心理學(xué)的運(yùn)用發(fā)揮著重要作用。 本文第一章首先介紹了犯罪心理學(xué)的基礎(chǔ)知識(shí)包括犯罪心理學(xué)的概念和研究?jī)?nèi)容,然后討論了犯罪心理學(xué)運(yùn)用于刑事偵查工作的必要性和可能性,最后介紹了現(xiàn)代刑事偵查活動(dòng)中運(yùn)用犯罪心理學(xué)的主要技術(shù)。 第二章介紹了犯罪心理學(xué)在刑事案件現(xiàn)場(chǎng)勘查中的運(yùn)用。包括現(xiàn)場(chǎng)心理痕跡分析的概念和原理、現(xiàn)場(chǎng)心理痕跡分析技術(shù)在我國(guó)的發(fā)展和運(yùn)用,并重點(diǎn)論述了現(xiàn)場(chǎng)心理痕跡分析在刑事偵查中的具體作用:包括根據(jù)不同案件中心理痕跡的共同性決定是否組織并案?jìng)刹?依據(jù)心理痕跡的反常性識(shí)別犯罪人的偽裝行為和利用心理痕跡體現(xiàn)犯罪人的人格特征,縮小犯罪嫌疑人范圍和確定犯罪嫌疑人。作者認(rèn)為:現(xiàn)場(chǎng)勘查不應(yīng)僅僅局限于對(duì)物質(zhì)痕跡的提取,還要重視對(duì)犯罪分子心理痕跡的分析,科學(xué)重建其作案過程,發(fā)現(xiàn)相關(guān)的案件線索。 第三章論述了犯罪心理學(xué)在偵緝抓捕中的運(yùn)用。本部分首先介紹了偵緝抓捕的基本知識(shí),接著分析了犯罪行為發(fā)生后犯罪分子的心理特征,最后重點(diǎn)論述了犯罪心理學(xué)在偵查緝捕中的運(yùn)用:根據(jù)犯罪嫌疑人的心理把握其逃跑路線和區(qū)域、利用犯罪嫌疑人的心理促使其暴露并伺機(jī)捕獲。作者認(rèn)為:只有掌握了犯罪分子案后的心理,才能“先人一步”地把握其動(dòng)向,提高緝捕的效率。 第四章論述了犯罪心理學(xué)在訊問中的運(yùn)用。本部分首先介紹了審訊的概念和特征,然后介紹了審訊對(duì)象在審訊過程中的心理狀態(tài)及變化規(guī)律。最后在前兩者的基礎(chǔ)上深入論述了犯罪心理學(xué)在審訊中的運(yùn)用,包括針對(duì)犯罪嫌疑人的心理營(yíng)造訊問氛圍、針對(duì)犯罪嫌疑人的心理巧用訊問語(yǔ)言和針對(duì)犯罪嫌疑人的心理巧用證據(jù)。作者認(rèn)為:只有準(zhǔn)確把握了犯罪嫌疑人的抗審心理,才能攻心為上進(jìn)行“點(diǎn)穴”,提高審訊水平,提高對(duì)疑難案件的攻堅(jiān)能力。
[Abstract]:In the current criminal investigation work in China, the difficulty of finding, investigating, arresting and interrogating put forward great challenges to the traditional investigative techniques, except for the use of high-tech means such as DNA, information technology, etc. We should also strengthen the application of criminal psychology in criminal investigation. The application of criminal psychology plays an important role in the field investigation of criminal cases, detection, arrest, interrogation, and other criminal investigation activities. The first chapter first introduces the basic knowledge of criminal psychology, including the concept and research content of criminal psychology, and then discusses the necessity and possibility of applying criminal psychology to criminal investigation. Finally, it introduces the main techniques of applying criminal psychology in modern criminal investigation. The second chapter introduces the application of criminal psychology in scene investigation of criminal cases. Including the concept and principle of locale psychological trace analysis, the development and application of locale psychological trace analysis technology in China. It also focuses on the specific role of psychological trace analysis in criminal investigation, including deciding whether to organize the joint investigation according to the commonality of psychological trace in different cases; According to the abnormal psychological trace, we can identify the criminal's camouflage behavior and use the psychological trace to reflect the criminal's personality characteristic, reduce the scope of the criminal suspect and determine the criminal suspect. The author thinks that the scene investigation should not only be limited to the extraction of the material trace, but also pay attention to the analysis of the psychological trace of the criminal element, scientifically reconstruct its criminal process, and find the relevant clues of the case. The third chapter discusses the criminal psychology in the application of arrest. This part first introduces the basic knowledge of arrest and arrest, and then analyzes the psychological characteristics of criminals after the occurrence of criminal acts. Finally, the application of criminal psychology in investigation and arrest is discussed emphatically: according to the psychology of criminal suspect, the escape route and region are grasped, and the criminal suspect's psychology is used to promote his exposure and opportunity to capture. The author thinks that only by mastering the psychology of criminals can they grasp the trend and improve the efficiency of arrest. Chapter four discusses the application of criminal psychology in interrogation. This part first introduces the concept and characteristics of interrogation, and then introduces the psychological state and the law of change of the subject in the process of interrogation. Finally, on the basis of the former two, the author deeply discusses the application of criminal psychology in interrogation, including the psychological construction of interrogation atmosphere for criminal suspects. The psychology of the criminal suspect uses the interrogation language and the psychology of the suspect skillfully uses the evidence. The author thinks that only by accurately grasping the criminal suspect's psychology of resisting trial can we carry out the "point", improve the level of interrogation, and improve the ability to attack difficult cases.
