【摘要】： 網(wǎng)絡(luò)已成為都市人生活必不可少的一部分,網(wǎng)絡(luò)秩序更是對(duì)社會(huì)秩序有著重大影響,良好的網(wǎng)絡(luò)秩序是構(gòu)建和諧社會(huì)、創(chuàng)建平安中國(guó)的一個(gè)前提條件,只有了解網(wǎng)絡(luò)犯罪才能更好的打擊網(wǎng)絡(luò)犯罪,才能使網(wǎng)絡(luò)秩序向健康、有序的方向發(fā)展,所以現(xiàn)在對(duì)網(wǎng)絡(luò)犯罪的研究越發(fā)顯得必要。本文采用從案例出發(fā)的寫(xiě)作方式,緊緊圍繞中西方已經(jīng)出現(xiàn)的案例進(jìn)行研究得出結(jié)論。 網(wǎng)絡(luò)犯罪是近年來(lái)隨計(jì)算機(jī)和網(wǎng)絡(luò)而共同出現(xiàn)的新犯罪形式,將網(wǎng)絡(luò)犯罪作為一種單獨(dú)的犯罪形式加以研究最重要的原因是與傳統(tǒng)犯罪相比網(wǎng)絡(luò)犯罪有著自己的特點(diǎn),為了更好的打擊網(wǎng)絡(luò)犯罪,首先要了解網(wǎng)絡(luò)犯罪的特點(diǎn)。本文先歸納了網(wǎng)絡(luò)犯罪區(qū)別與傳統(tǒng)犯罪的特點(diǎn),如主體的高智能性、犯罪的隱蔽性、犯罪主體的年輕化等,又進(jìn)一步從犯罪構(gòu)成上分析網(wǎng)絡(luò)犯罪的特點(diǎn),將網(wǎng)絡(luò)犯罪在犯罪主體、犯罪主觀方面、犯罪客體、犯罪客觀方面的特點(diǎn)均加以分析。 文章進(jìn)一步研究了現(xiàn)實(shí)案例中比較多見(jiàn)或?qū)W(wǎng)絡(luò)秩序有較大影響的典型網(wǎng)絡(luò)犯罪,其中最主要的有:關(guān)于網(wǎng)絡(luò)虛擬財(cái)產(chǎn)的犯罪、網(wǎng)絡(luò)賭博和網(wǎng)絡(luò)色情犯罪。對(duì)于有關(guān)網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的研究先從網(wǎng)絡(luò)虛擬財(cái)產(chǎn)是否屬于財(cái)物的范圍這一問(wèn)題入手,進(jìn)而引出對(duì)網(wǎng)絡(luò)虛擬財(cái)產(chǎn)價(jià)值的研究,回答了兩個(gè)問(wèn)題:網(wǎng)絡(luò)虛擬財(cái)產(chǎn)有沒(méi)有價(jià)值和網(wǎng)絡(luò)虛擬財(cái)產(chǎn)的價(jià)值如何計(jì)算?有關(guān)網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的研究最終落在立法上,根據(jù)港、澳、臺(tái)及西方國(guó)家針對(duì)此類犯罪的立法經(jīng)驗(yàn)看出,我國(guó)通過(guò)法律解釋和法律修改等方式,明確網(wǎng)財(cái)?shù)呢?cái)產(chǎn)的性質(zhì),使網(wǎng)絡(luò)虛擬財(cái)產(chǎn)受到刑法的保護(hù),現(xiàn)在來(lái)說(shuō)是較易實(shí)現(xiàn)的。網(wǎng)絡(luò)賭博犯罪的研究本文主要采取與最高人民法院、最高人民檢察院發(fā)布的《關(guān)于辦理賭博刑事案件具體應(yīng)用法律若干問(wèn)題的解釋》相結(jié)合的方式,解釋了網(wǎng)絡(luò)賭博犯罪的概念和方式。又因網(wǎng)絡(luò)賭博多是跨國(guó)犯罪,本文對(duì)網(wǎng)絡(luò)賭博犯罪的管轄問(wèn)題加以闡述。最后,針對(duì)網(wǎng)絡(luò)賭博案件偵查難,本文提出網(wǎng)絡(luò)賭博案的偵查策略和網(wǎng)絡(luò)賭博的防治策略。網(wǎng)絡(luò)色情犯罪是離普通網(wǎng)絡(luò)用戶最近的一種網(wǎng)絡(luò)犯罪,黃色網(wǎng)站履禁不絕,網(wǎng)絡(luò)色情犯罪的形式有:(1)網(wǎng)上販賣(mài)淫穢物品牟利、(2)網(wǎng)上傳播淫穢物品、(3)網(wǎng)上傳播淫穢物品牟利、(4)為網(wǎng)絡(luò)色情犯罪提供幫助。色情犯罪對(duì)青少年的身心健康都有著惡劣的影響,對(duì)網(wǎng)絡(luò)中的兒童色情犯罪的處罰應(yīng)嚴(yán)于普通的網(wǎng)絡(luò)色情犯罪,故本文對(duì)此加以單獨(dú)的研究。常見(jiàn)的網(wǎng)絡(luò)犯罪還有:網(wǎng)絡(luò)入侵、利用計(jì)算機(jī)病毒犯罪、網(wǎng)絡(luò)詐騙、網(wǎng)上侵犯公民人身權(quán)利、民主權(quán)利的犯罪、網(wǎng)上恐怖犯罪和利用網(wǎng)絡(luò)銷(xiāo)售贓物的犯罪,本文都以專節(jié)論述。
[Abstract]:Network has become an indispensable part of urban people's life, and the network order has a great influence on the social order. A good network order is a prerequisite for building a harmonious society and creating a peaceful China. Only by understanding the network crime can we attack the network crime better, and make the network order to be healthy and orderly. Therefore, the research on network crime is becoming more and more necessary. This paper adopts the writing method from the case of the case, and draws the conclusion closely around the cases that have already appeared in China and the West.
Network crime is a new form of crime with computer and network in recent years. The most important reason for the study of network crime as a separate form of crime is that network crime has its own characteristics compared with the traditional crime. In order to better combat network crime, we must first understand the characteristics of network crime. The characteristics of the distinction of network crime and the traditional crime, such as the high intelligence of the subject, the concealment of the crime, the youth of the criminal subject, are further analyzed from the constitution of the crime, and the characteristics of the network crime in the subject of crime, the subjective aspect of the crime, the object of the crime and the objective aspects of the crime are analyzed.
This paper further studies the typical network crimes which are more common in the actual cases or have a great impact on the network order, the most important of which are: the crime of network virtual property, network gambling and network pornography crime. The research on the network virtual property crime is first from the scope of the property of the network virtual property Starting with the problem, it leads to the study of the value of the virtual property of the network, and answers two questions: how is the value of the virtual property of the network and the value of the virtual property of the network calculated? The research on the crime of virtual property of the network finally falls on the legislation, and the legislative experience of the crime in Hong Kong, Australia, Taiwan and the west is seen in our country. By means of legal interpretation and legal modification, the nature of the property of the net property is clearly defined, and the virtual property of the network is protected by the criminal law. Now it is easier to realize it. The research on the crime of network gambling is mainly adopted by the Supreme People's court, the supreme people's Procuratorate, on the specific application of the law on gambling criminal cases. It explains the concept and way of network gambling crime, and explains the concept and way of network gambling crime. And because network gambling is a transnational crime, this paper expounds the jurisdiction of network gambling crime. Finally, this paper puts forward the investigation strategy of network gambling case and the prevention strategy of network gambling. Love crime is a kind of network crime nearest to ordinary Internet users. The yellow web site is banned, and the forms of network pornography crime are: (1) selling obscene articles on the Internet, (2) Disseminating Obscene Articles on the Internet, (3) making profit by Disseminating Obscene Articles on the Internet, (4) providing help for Internet pornography crime. The bad influence, the punishment of child pornography in the network should be strict with the common network pornography crime, so this article is a separate study. The common network crimes are network invasion, the use of computer virus crime, network fraud, the infringement of citizen's personal rights, the crime of democratic rights, the Internet terrorist crime and the use of network. The crime of selling stolen goods by collaterals is discussed in the special section.
