【摘要】： 二十一世紀(jì)是一個(gè)科技日新月異的時(shí)代，其中最引人注目的就是信息產(chǎn)業(yè)進(jìn)入了高速發(fā)展時(shí)期。信息網(wǎng)絡(luò)的普及逐漸在改變著人們的傳統(tǒng)生產(chǎn)生活方式，還帶來(lái)了社會(huì)其他各個(gè)方面的變革。與此同時(shí)也對(duì)社會(huì)秩序的穩(wěn)定造成了巨大的沖擊——人們的交往途徑從現(xiàn)實(shí)走向虛擬空間，同時(shí)社會(huì)個(gè)體的人性弱點(diǎn)開(kāi)始在網(wǎng)絡(luò)中得到萌發(fā)與張揚(yáng)，，其表現(xiàn)形式為不少人想通過(guò)網(wǎng)絡(luò)來(lái)宣泄個(gè)人對(duì)社會(huì)的不滿，利用網(wǎng)絡(luò)來(lái)從事各種犯罪活動(dòng)；青少年一代進(jìn)入到網(wǎng)絡(luò)社會(huì)中，并成為互聯(lián)網(wǎng)的主體，青少年犯罪率迅速上升；一些不良社會(huì)影響通過(guò)網(wǎng)絡(luò)媒體的快速傳播并被青少年群體模仿甚至創(chuàng)造出更邪惡的形式，各種犯罪活動(dòng)在網(wǎng)絡(luò)的蔽護(hù)下顯得更加隱蔽。在這樣一個(gè)大的背景之下，網(wǎng)絡(luò)社會(huì)的治安問(wèn)題日顯突出。 基于網(wǎng)絡(luò)的社會(huì)活動(dòng)是當(dāng)代人類社會(huì)生活的一個(gè)越來(lái)越重要的方面，維護(hù)網(wǎng)絡(luò)社會(huì)的公共秩序的安全是當(dāng)前公安部門(mén)的當(dāng)務(wù)之急，因此采用怎樣的治安管理措施來(lái)確保政治的安定團(tuán)結(jié)和社會(huì)的正常運(yùn)行尤為重要。網(wǎng)絡(luò)社會(huì)不同與傳統(tǒng)社會(huì)有其自身的獨(dú)特一面，所以傳統(tǒng)的治安體制在網(wǎng)絡(luò)面前顯得有些力不從心，還不足以完全控制整個(gè)信息化時(shí)代的社會(huì)局面，治安措施必須在原有的技術(shù)上大力創(chuàng)新。 本文基于對(duì)網(wǎng)絡(luò)社會(huì)高自由度、開(kāi)放性、虛擬性等特征的描述，結(jié)合大量網(wǎng)絡(luò)犯罪事實(shí)和案例的分析，提出犯罪手段更加隱蔽、犯罪手段高度技術(shù)化、犯罪主體青少年化是當(dāng)前網(wǎng)絡(luò)犯罪的主要特征；基于人類社會(huì)從工業(yè)社會(huì)向信息社會(huì)轉(zhuǎn)型的社會(huì)歷史背景，分析了網(wǎng)絡(luò)犯罪問(wèn)題凸現(xiàn)的社會(huì)文化原因、社會(huì)心理原因及法律制度缺失等方面的原因。 歐洲，美國(guó)韓國(guó)等國(guó)家和地區(qū)在經(jīng)濟(jì)的支撐下早已經(jīng)踏上了信息高速公路的進(jìn)程，它們?cè)谛畔⒒l(fā)展道路上遇到的困難的解決，為國(guó)內(nèi)的網(wǎng)絡(luò)發(fā)展中遇到的治安問(wèn)題的解決起到很好的示范作用，在借鑒國(guó)外先進(jìn)經(jīng)驗(yàn)的基礎(chǔ)上，結(jié)合我國(guó)的實(shí)際狀況提出了加強(qiáng)青少年網(wǎng)絡(luò)道德教育工作，引導(dǎo)公民健康的網(wǎng)絡(luò)文化觀念、提高警務(wù)人員的思想道德素養(yǎng)和提高現(xiàn)代化條件下辦案能力、充分發(fā)揮群眾的社會(huì)監(jiān)督和舉報(bào)作用等解決網(wǎng)絡(luò)社會(huì)治安問(wèn)題的對(duì)策。
[Abstract]:The 21 century is an era of rapid development of science and technology, in which the information industry has entered a period of rapid development. The popularization of information network is changing people's traditional way of production and life, and it also brings about the change of other aspects of society. At the same time, it also caused a huge impact on the stability of social order-people's way of communication from reality to virtual space, at the same time, the human weakness of social individuals began to germinate and spread in the network. Its manifestation is that many people want to vent their dissatisfaction with the society through the network, use the network to engage in various criminal activities, the youth generation into the network society, and become the main body of the Internet, the juvenile crime rate is rising rapidly; Some bad social influences spread quickly through the network media and were imitated or even created a more evil form by the youth group. All kinds of criminal activities appear to be more hidden under the protection of the network. Under such a big background, the network society's public order problem becomes more and more prominent. Network-based social activities are an increasingly important aspect of contemporary human social life. It is imperative for the public security departments to maintain the public order of the network society. Therefore, what kind of security management measures should be adopted to ensure political stability and social normal operation is particularly important. The difference between the network society and the traditional society has its own unique side, so the traditional public security system seems to be unable to do what it wants in front of the network, and it is not enough to completely control the social situation in the entire information age. Public security measures must be innovated in the original technology. Based on the description of the characteristics of network society, such as high degree of freedom, openness and fictiveness, combined with the analysis of a large number of network crime facts and cases, this paper puts forward that the criminal means are more subtle, and the criminal means are highly technical. The juvenile crime subject is the main feature of the current cybercrime, based on the social and historical background of the transition from the industrial society to the information society, the social and cultural reasons for the problem of cybercrime are analyzed. Social psychological reasons and the lack of legal system and other reasons. Europe, the United States and South Korea and other countries and regions have already embarked on the process of the information superhighway under the support of the economy. They have encountered difficulties in solving the difficulties encountered on the road of information development. It plays a good role in demonstrating the solution of the public security problems encountered in the development of the domestic network. On the basis of drawing lessons from the advanced experience of foreign countries and combining the actual situation of our country, this paper proposes to strengthen the work of network moral education for teenagers. The countermeasures to solve the problems of network social security are to guide citizens' healthy concept of network culture, to improve the ideological and moral accomplishment of police personnel and to improve the ability of handling cases under the modern conditions, and to give full play to the social supervision and reporting role of the masses.
