【摘要】：本文首先闡明社區(qū)矯正的概念和基本特征,采用歷史研究和比較研究的方法,梳理國內(nèi)外社區(qū)矯正的發(fā)展歷史和實踐情況。然后通過社會調(diào)查獲得蘭州市城關(guān)區(qū)社區(qū)矯正試點的第一手翔實資料,分析城關(guān)區(qū)社區(qū)矯正試點存在的缺陷,缺陷主要表現(xiàn)在五個方面：第一,重刑觀念與社區(qū)矯正刑罰觀念沖突,缺乏社會寬容精神。第二,社區(qū)組織和機制發(fā)展不完善以及社區(qū)自治組織發(fā)育不成熟,社區(qū)矯正基礎(chǔ)薄弱。第三,社區(qū)矯正缺少具體可操作性的程序規(guī)定。第四,非監(jiān)禁刑適用比例較低,社區(qū)矯正司法制度有待完善。第五,社區(qū)矯正執(zhí)行主體人員、人員素質(zhì)缺失、社會團體缺位、社會志愿者不足,社區(qū)矯正執(zhí)行制度部分缺失。在此基礎(chǔ)上,借鑒國內(nèi)外社區(qū)矯正實踐經(jīng)驗,認為建構(gòu)、強化社區(qū)矯正制度的主要對策有七個方面：第一,加強社區(qū)矯正宣傳,樹立民眾與司法人員現(xiàn)代刑罰理念。第二,推進社區(qū)建設(shè),培育和發(fā)展非政府組織,優(yōu)化社區(qū)矯正社會基礎(chǔ)環(huán)境。第三,建立健全社區(qū)矯正相關(guān)程序規(guī)范性文件。第四,擴大非監(jiān)禁刑適用比例,構(gòu)建轉(zhuǎn)向處理制度、判決前人格調(diào)查制度、社區(qū)矯正聽證程序制度和犯罪記錄消滅制度。第五,適度增加司法所工作人員、建立社區(qū)矯正社會團體、充實社會志愿者隊伍；構(gòu)建社區(qū)矯正人身危險性評估制度、社區(qū)矯正的累進處遇制度、社區(qū)矯正對象的分管分矯制度、個案矯正制度、社區(qū)矯正教育效果評估制度、心理矯治及心理評估制度、幫扶助困制度和公益勞動制度。第六,完善法律監(jiān)督,加強社會監(jiān)督,強化社區(qū)矯正監(jiān)督體制。第七,社區(qū)矯正經(jīng)費納入財政預(yù)算,拓寬經(jīng)費來源渠道,提供物質(zhì)保障；利用電子信息技術(shù),加強社區(qū)矯正信息化建設(shè),提供社區(qū)矯正技術(shù)保障,完善社區(qū)矯正保障機制。
[Abstract]:This paper first clarifies the concept and basic characteristics of community correction, and combs the development history and practice of community correction at home and abroad by means of historical research and comparative study. Then through the social investigation to obtain the first-hand detailed information of the pilot community correction in Chengguan District of Lanzhou City, and analyze the defects in the pilot project of community correction in Chengguan District. The defects are mainly reflected in five aspects: first, The concept of severe punishment conflicts with the concept of community correction penalty and lacks the spirit of social tolerance. Second, the development of community organization and mechanism is not perfect, and the development of community autonomy organization is immature, and the foundation of community correction is weak. Third, community correction lacks specific operational procedural provisions. Fourth, the proportion of non-custodial punishment is low, and the judicial system of community correction needs to be improved. Fifth, community correction executive personnel, lack of personnel quality, lack of social groups, lack of social volunteers, community correction implementation system is partially missing. On this basis, draw lessons from the practical experience of community correction at home and abroad, think that there are seven main countermeasures to construct and strengthen the community correction system: first, strengthen the publicity of community correction, set up the concept of modern punishment of the public and judicial personnel. Second, promote community construction, cultivate and develop non-governmental organizations and optimize the basic social environment of community correction. Third, establish and perfect the normative documents of community correction procedures. Fourthly, we should expand the proportion of non-custodial punishment, construct the system of disposition, the system of personality investigation before judgment, the system of hearing procedure of community correction and the system of eliminating criminal record. Fifth, appropriately increase the number of judicial staff, set up community correction social organizations, enrich social volunteers, construct community correction personal risk assessment system, community correction progressive treatment system, Community correction system, case correction system, community correction education evaluation system, psychological correction and psychological evaluation system, help difficult system and public labor system. Sixth, improve legal supervision, strengthen social supervision, and strengthen the community correction supervision system. Seventh, the funds for community correction should be included in the financial budget, the sources of funds should be widened, and the material security should be provided. The electronic information technology should be used to strengthen the information construction of community correction, to provide the technical guarantee for community correction and to perfect the mechanism of community correction.
