【摘要】：改革開(kāi)放以來(lái),隨著經(jīng)濟(jì)的迅速發(fā)展,城市迅速擴(kuò)大。伴隨著城市的迅速擴(kuò)張,城市交通運(yùn)輸供給日趨緊張,城市客運(yùn)出現(xiàn)了供需失衡的局面,于是“黑車(chē)”應(yīng)運(yùn)而生。當(dāng)前“黑車(chē)”已經(jīng)成為我國(guó)許多城市交通運(yùn)輸?shù)能浝?嚴(yán)重?cái)_亂了市場(chǎng)正常的運(yùn)營(yíng)秩序,不僅侵害了合法經(jīng)營(yíng)者的利益,而且影響了城市形象。近年來(lái),雖然各城市政府出臺(tái)了相關(guān)整治城市“黑車(chē)”的相關(guān)政策,各城市交通運(yùn)管部門(mén)也相繼開(kāi)展了整治“黑車(chē)”的行動(dòng),但是相關(guān)問(wèn)題并沒(méi)有得到解決,我們看到的是有些政府為了整治“黑車(chē)”不惜“釣魚(yú)執(zhí)法”,甚至出現(xiàn)違法行為。目前,“黑車(chē)”依然泛濫,且有愈演愈烈之勢(shì)。因此,找到“黑車(chē)”產(chǎn)生的根源,進(jìn)而分析政府在整治城市“黑車(chē)”中存在的問(wèn)題,解決政府在整治“黑車(chē)”中所遇到的困境,對(duì)規(guī)范城市正常的客運(yùn)市場(chǎng)秩序以及維護(hù)城市安全和形象都有著重要意義。 本文以政府整治城市“黑車(chē)”出臺(tái)的政策為研究對(duì)象,結(jié)合實(shí)地訪談,以探尋“黑車(chē)”存在的機(jī)理為突破點(diǎn),運(yùn)用市場(chǎng)供求理論、博弈理論、動(dòng)機(jī)理論以等理論對(duì)“黑車(chē)”存在的機(jī)理進(jìn)行分析。同時(shí)分析城市“黑車(chē)”存在的內(nèi)部原因和外部原因,認(rèn)為當(dāng)前“黑車(chē)”屢治不絕,與政府整治城市“黑車(chē)”出臺(tái)的各項(xiàng)政策有直接的聯(lián)系。文章認(rèn)為政府為整治城市“黑車(chē)”而出臺(tái)政策在政策制定、政策執(zhí)行、和政策制定中都存在一定的缺陷,當(dāng)前的“黑車(chē)”整治政策目標(biāo)不清、政策缺乏操作性和公共性,在執(zhí)行中由于地方政府以及其他利益團(tuán)體的層層阻撓,政策難以執(zhí)行。另外政策監(jiān)督缺失,導(dǎo)致違法行為屢見(jiàn)不鮮,損害了政府的權(quán)威。本文分析了政策制定、政策執(zhí)行以及政策監(jiān)督存在問(wèn)題的原因,提出了完善現(xiàn)有整治政策的建議,認(rèn)為政府應(yīng)該重構(gòu)政策問(wèn)題、重建政策目標(biāo)、重構(gòu)管制政策,加大政策執(zhí)行和監(jiān)督的力度,進(jìn)而從根本上肅清“黑車(chē)”。
[Abstract]:Since the reform and opening up, with the rapid development of the economy, with the rapid expansion of the city, with the rapid expansion of the city, the supply and supply of urban transportation is becoming increasingly tense, and the imbalance of supply and demand has emerged in urban passenger transport, so the "black car" emerges as the times require. The current "black car" has become a soft rib of many cities in China, and seriously disrupts the market. The normal operation order not only infringes on the interests of the legal operators, but also affects the city image. In recent years, although the relevant policies of the urban "black car" have been issued by various urban governments, the traffic management departments of each city have also carried out the action of the "black car", but the related problems have not been solved, we see At present, the "black car" is still overflowing, and there is a growing trend. Therefore, to find the root of the "black car", and then analyze the problem that the government has saved in the city "black car", to solve the government in the "black car" in the encounter. The predicament is of great significance to normalize the normal order of passenger transport market and safeguard the safety and image of the city.
In this paper, based on the policy of government regulation of city "black car" as the research object, in order to explore the mechanism of "black car" as a breakthrough point, the mechanism of the existence of "black car" is analyzed with the theory of market supply and demand, game theory and motivation theory, and the internal reasons for the existence of "black car" in city are analyzed. The article holds that the government has some defects in policy making, policy implementation and policy making, and the current policy goal of "black car" regulation is not the goal. The policy is not operational and public, and the policy is difficult to carry out in the implementation of the local government and other interest groups. In addition, the lack of policy supervision leads to the violation of the illegal behavior and the authority of the government. This paper analyses the reasons for the problems of policy making, policy implementation and policy supervision, and puts forward the reasons for the problems. The suggestion of improving the existing regulation policy is that the government should reconstruct the policy problem, rebuild the policy goal, reconstruct the control policy, increase the enforcement and supervision of the policy, and then eliminate the "black car" fundamentally.
