【摘要】：始創(chuàng)于1955年的勞動(dòng)教養(yǎng)制度,在越來越多的聚焦和爭議中,終于在2013年初走到了盡頭,面臨著改革的命運(yùn)。伴隨著這項(xiàng)制度近60年的發(fā)展歷程,其適用對象也在不斷的變遷。勞動(dòng)教養(yǎng)制度的改革,首先需要明確管理對象的選擇。對象的客觀存在,決定了改革的性質(zhì)和方向。本文即以勞動(dòng)教養(yǎng)對象為主線,縱向梳理其歷史變遷,客觀歸納其演變的特點(diǎn),分析對象選擇背后的法理基礎(chǔ)。通過對理論基礎(chǔ)的研究,反思其中的時(shí)代局限性和隱含的沖突。在沖突中,思考對象的法律權(quán)利與人權(quán)保障等問題。最后,通過與國外相似制度的橫向比較,對他們的制度優(yōu)勢加以本土化考慮,從而找到當(dāng)下勞動(dòng)教養(yǎng)對象的現(xiàn)實(shí)歸宿。作為勞動(dòng)教養(yǎng)工作末期的參與者和見證者,本人在文中將理論研究和司法實(shí)踐相結(jié)合,通過對不同對象展開分析,為制度的改革提供一些具有操作性的建議。
[Abstract]:The system of reeducation through labor, which was founded in 1955, has finally come to an end in early 2013 amid increasing focus and controversy, and is facing the fate of reform. With the development of this system in the past 60 years, the object of application is constantly changing. The reform of reeducation through labor system needs to make clear the choice of management object. The objective existence of the object determines the nature and direction of the reform. This article takes the object of reeducation through labor as the main line, combs its historical change longitudinally, sums up the characteristics of its evolution objectively, and analyzes the legal basis behind the choice of object. Through the study of the theoretical basis, reflect on the limitations of the times and hidden conflicts. In the conflict, the legal rights of the object and human rights protection and other issues. Finally, through the horizontal comparison with the similar institutions in foreign countries, the author considers their institutional advantages locally and finds out the realistic destination of the present reeducation through labor. As a participant and witness in the end of reeducation through labor, I combine the theoretical research with judicial practice in this paper, through the analysis of different objects, I provide some operable suggestions for the reform of the system.
