【摘要】：安徽省臨泉縣因外流販毒犯罪問題突出，被國家禁毒委員會列為全國毒品嚴重地區(qū)之一。經(jīng)過5年多的集中整治工作，改變了外流販毒犯罪突出的現(xiàn)狀。日前，國家禁毒委員會已宣布：臨泉縣不再列為全國毒品問題嚴重地區(qū)。為徹底解決臨泉縣的毒品問題，有必要研究臨泉縣外流販毒的規(guī)律特點，分析其成因，總結(jié)整治工作經(jīng)驗對策，以鞏固集中整治毒品問題的成果。 “外流販毒”是國家禁毒委員會對跨區(qū)域地走私、販賣、運輸毒品犯罪的通俗叫法。從《刑法學》的角度看，“外流販毒”是指以獲取非法暴利為動機，以走私、販賣、運輸毒品為目的，而實施的跨區(qū)域流竄犯罪活動，它直接侵害的是國家對毒品的管理制度，它間接的侵害了人民的生命健康、公私財產(chǎn)以及社會和經(jīng)濟秩序。這種犯罪隱蔽性極強，難以發(fā)現(xiàn)，難以證實，，難以將整個犯罪團伙一網(wǎng)打盡。 臨泉縣外流販毒的產(chǎn)生與發(fā)展，原因非常復(fù)雜，既有政治、經(jīng)濟、文化的原因，也有歷史和現(xiàn)實原因，既有客觀方面的原因，也有主觀方面的原因。種植罌粟、吸食鴉片是歷史原因；人口與經(jīng)濟的矛盾是根本原因；毒品消費市場的存在是現(xiàn)實原因；與相鄰兩縣毒品互相滲透是地理原因；犯罪分子追求暴利是內(nèi)在原因；世界毒潮泛濫是國際原因；走私販毒活動自身的規(guī)律作用是重要原因；市場經(jīng)濟建立過程中的負面效應(yīng)是社會原因；打擊不力是直接原因。 要徹底解決臨泉的毒品問題，必須抓住外流販毒這一主要矛盾，以打擊開路，實行綜合治理。
[Abstract]:Linquan County in Anhui Province is listed as one of the serious drug regions by the National Drug Control Commission. After more than 5 years of concentrated rectification work, changed the outflow of drug-trafficking crime outstanding status. A few days ago, the National Drug Control Commission has announced that Linquan County is no longer listed as a serious drug problem area. In order to thoroughly solve the drug problem in Linquan County, it is necessary to study the characteristics of the law of the outflow drug trafficking in Linquan County, analyze its causes, sum up the experience and countermeasures of the rectification work, so as to consolidate the achievements of centralized drug control. "outflow and drug trafficking" is a popular term used by the National Drug Control Commission for the crime of smuggling, trafficking and transporting drugs across regions. From the perspective of "Criminal Law", the term "outflow of drug trafficking" refers to the transnational criminal activities carried out for the purpose of smuggling, trafficking and transporting drugs with the motive of obtaining illegal and profiteering profits, which directly infringes on the state's drug management system. It indirectly infringes people's lives and health, public and private property, and social and economic order. This kind of crime is extremely hidden, difficult to find, difficult to prove, difficult to capture the whole gang. The reasons for the emergence and development of the outflow of drug trafficking in Linquan County are very complicated, including political, economic, cultural, historical and practical reasons, objective and subjective reasons. Opium poppy cultivation and opium consumption are the historical reasons; the contradiction between population and economy is the fundamental cause; the existence of the drug consumption market is the realistic reason; the geographical reason is the infiltration of drugs with neighboring counties; the criminal pursuit of profiteering is the intrinsic reason; The world drug tide is the international cause, the regular function of smuggling and drug trafficking is the important reason, the negative effect in the establishment of market economy is the social reason, and the direct reason is the weak strike. In order to solve the drug problem in Linquan thoroughly, we must grasp the main contradiction of outward flow and drug trafficking in order to crack down on the open road and carry out comprehensive management.
