【摘要】： 在經(jīng)濟(jì)大發(fā)展,城市大繁榮的背景下,在現(xiàn)有的二元戶籍結(jié)構(gòu)下,我國流動人口尤其是流入大中城市的人口,有著經(jīng)濟(jì)驅(qū)動為主、青壯年為主、增長迅速、平均文化水平低等特點,這個特殊的群體在為城市建設(shè)做出巨大貢獻(xiàn)的同時,也帶來了城市管理、社會治安等諸多問題,如何做到有序、合理流動,興利除弊,是當(dāng)前政府和社會都十分關(guān)心又非常迫切的問題。作為流動人口管理的主力軍,公安機關(guān)一直在綜合治理中發(fā)揮著重要作用,在開展戶口登記、加強治安管理、打擊違法犯罪上取得了一定的成果。但當(dāng)前流動人口管理法律、法規(guī)體系在民主的進(jìn)程中不斷完善,社會環(huán)境、治安環(huán)境也在變化中發(fā)展,公安機關(guān)的執(zhí)法環(huán)境、執(zhí)法依據(jù)、執(zhí)法手段也必須隨之而變化,公安執(zhí)法工作面臨著新的問題和挑戰(zhàn)。 本文嘗試從流動人口管理中公安執(zhí)法的角度,以筆者所在嘉定區(qū)的公安管理實踐為基礎(chǔ),分析當(dāng)前的流動人口管理的法律環(huán)境、治安環(huán)境和社會環(huán)境,探討公安機關(guān)在流動人口管理過程中發(fā)揮的作用、取得的成績、遇到的問題,并著重從開展信息登記、控制違法犯罪兩個角度討論公安執(zhí)法的難點和發(fā)展方向,對流動人口治安管理提出個人的設(shè)想和建議,以求在公安執(zhí)法的變革中探索流動人口治安管理的正確方向。
[Abstract]:Under the background of the great economic development and the great prosperity of the city, under the existing dual household registration structure, the floating population in our country, especially the population flowing into the large and medium-sized cities, is mainly driven by the economy, dominated by the young and middle-aged, and has a rapid growth. This special group, while making great contributions to urban construction, has also brought many problems, such as urban management, social security, and so on. How to achieve orderly and reasonable flow, do beneficial things, and eliminate abuses, Is the current government and society are very concerned about and very urgent issues. As the main force of floating population management, the public security organ has been playing an important role in comprehensive management, and has made certain achievements in carrying out household registration, strengthening public security management and cracking down on illegal and criminal activities. However, the current laws and regulations governing the floating population have been continuously improved in the process of democracy. The social environment and the public security environment are also developing. The law enforcement environment of public security organs, the basis of law enforcement, and the means of law enforcement must also change with it. Public security law enforcement is facing new problems and challenges. This paper attempts to analyze the current legal environment, public security environment and social environment of floating population management from the perspective of public security law enforcement in floating population management and based on the practice of public security management in Jiading District, where the author is located. This paper probes into the role, achievements and problems of public security organs in the management of floating population, and emphatically discusses the difficulties and development direction of public security law enforcement from the two angles of developing information registration and controlling illegal crimes. In order to explore the correct direction of the public security management of the floating population in the reform of public security law enforcement, this paper puts forward some personal ideas and suggestions on the public security management of the floating population.
