【摘要】：警察制度史是國家起源和政治制度史研究的重要內(nèi)容。但是目前我國對(duì)警察制度及相前問題的研究一直是一個(gè)薄弱環(huán)節(jié)。本文結(jié)合大量史料,較系統(tǒng)地研究、考證了中國警察起源,形成及發(fā)展的歷史,并對(duì)如何推動(dòng)中國警察制度的創(chuàng)新,提出了建設(shè)性的構(gòu)想。 本文共分為四個(gè)部分:第一部分:中國古代警察制度的產(chǎn)生與發(fā)展。該部分介紹我國原始社會(huì)維持秩序的手段,奴隸社會(huì)警察的雛形,封建社會(huì)警察制度的發(fā)展,以及中國古代警察制度的特點(diǎn)等。第二部分:中國近代警察制度的創(chuàng)立。該部分介紹了中國近代警察制度的初創(chuàng)、警察機(jī)構(gòu)等,以及警政建設(shè)的特點(diǎn)。第三部分:新中國的警察制度一公安工作。該部分主要介紹了新中國警察制度初建、發(fā)展、壯大的歷史。第四部分:中國警察制度的進(jìn)一步完善。重點(diǎn)研究了中國加入世貿(mào)組織以后,在推動(dòng)政府行政機(jī)構(gòu)改革的同時(shí),也推動(dòng)了中國警察制度的創(chuàng)新。在警察制度創(chuàng)新中,重點(diǎn)突破警察權(quán)力理念、警察權(quán)力與人權(quán)關(guān)系、警察權(quán)力配置、警察執(zhí)法程序,警察權(quán)力制約等問題。警察制度創(chuàng)新的目標(biāo)是創(chuàng)建權(quán)力型、透明型、服務(wù)型、人權(quán)型警察。
[Abstract]:The history of police system is an important content in the history of national origin and political system. However, the study of police system and its former problems is always a weak link in our country. Based on a large number of historical data, this paper systematically studies the origin, formation and development of Chinese police, and puts forward a constructive idea on how to promote the innovation of Chinese police system. This paper is divided into four parts: the first part: the emergence and development of ancient Chinese police system. This part introduces the means of maintaining order in primitive society, the embryonic form of police in slave society, the development of police system in feudal society, and the characteristics of police system in ancient China. The second part: the establishment of the police system in modern China. This part introduces the establishment of modern Chinese police system, police institutions, and the characteristics of police construction. The third part: new China's police system-public security work. This part mainly introduces the history of the establishment, development and expansion of the new Chinese police system. The fourth part: the further improvement of China's police system. After China's entry into the WTO, it promotes the innovation of the Chinese police system as well as the reform of the government administration. In the innovation of police system, the emphasis is on breaking through the concept of police power, the relationship between police power and human rights, the allocation of police power, the police law enforcement procedure, the restriction of police power, and so on. The aim of police system innovation is to create police with power, transparency, service and human rights.
