【摘要】： 黑社會(huì)犯罪就是有組織犯罪。我國(guó)黑社會(huì)性質(zhì)組織犯罪，，是向典型黑社會(huì)犯罪過(guò)渡的一個(gè)中間形態(tài)。筆者根據(jù)我國(guó)涉黑犯罪的產(chǎn)生、發(fā)展，通過(guò)全國(guó)“打黑除惡”專項(xiàng)斗爭(zhēng)一些案例分析，認(rèn)為當(dāng)前我國(guó)的黑社會(huì)性質(zhì)組織犯罪已步入一個(gè)新的階段，呈現(xiàn)出犯罪普遍化，高度組織化，黑金政治化、犯罪國(guó)際化等特點(diǎn)。黑社會(huì)性質(zhì)組織犯罪是社會(huì)肌體上的一顆毒瘤，不僅嚴(yán)重破壞社會(huì)經(jīng)濟(jì)、生活秩序，直接侵害人民群眾生命財(cái)產(chǎn)安全，破壞社會(huì)治安穩(wěn)定，而且腐蝕拉攏國(guó)家工作人員和政法干警，為其發(fā)展坐大提供庇護(hù)，嚴(yán)重危害國(guó)家政權(quán)穩(wěn)定和黨群、干群關(guān)系。作者通過(guò)對(duì)黑社會(huì)性質(zhì)組織犯罪的特征和成因的分析，因地制宜地提出了打擊預(yù)防黑社會(huì)性質(zhì)組織犯罪的對(duì)策。
[Abstract]:Underworld crime is organized crime. The organized crime of underworld nature in our country is an intermediate form of transition to typical underworld crime. According to the emergence and development of criminal activities in China, and through the analysis of some cases in the national special struggle to "crack down on the criminal elements and eliminate evil", the author thinks that the organized crime of the underworld nature in our country has entered a new stage, showing the universality of the crime. Highly organized, black gold politicization, internationalization of crime and other characteristics. The organized crime of the underworld nature is a malignant tumor in the body of the society. It not only seriously damages the social economy and order of life, directly encroaches on the safety of the people's life and property, and undermines the social security and stability. Moreover, it corrupts the state functionaries and the political and legal cadres and policemen, and provides asylum for their development, thus seriously endangering the stability of the state power and the relations between the party and the masses, cadres and masses. Based on the analysis of the characteristics and causes of the organized crime in the nature of the underworld, the author puts forward countermeasures to combat and prevent the organized crime of the nature of the underworld in accordance with the local conditions.
