【摘要】： 本文主要研究國家工作人員的職務(wù)犯罪偵查方法,首先研究職務(wù)犯罪的概念和特征、職務(wù)犯罪偵查的內(nèi)容、職務(wù)犯罪偵查方法的特征和作用及應(yīng)遵循的原則;其次,也是本文最重要的部分是職務(wù)犯罪偵查方法研究,分為貪賄等經(jīng)濟(jì)犯罪案件的偵查方法研究和瀆職犯罪案件的偵查方法研究,具體對貪污、賄賂、挪用公款、私分國有資產(chǎn)、巨額財產(chǎn)來源不明、玩忽職守、濫用職權(quán)、徇私枉法犯罪案件的偵查方法進(jìn)行研究,通過研究,結(jié)合檢察工作實際案例,能夠更好地了解每種犯罪獨特的、有別于其它犯罪的查賬、預(yù)審、取證等偵查方法;最后,對職務(wù)犯罪偵查工作面臨的困難及對策進(jìn)行研究,目的是面對困難、心中有數(shù),找出更有利于職務(wù)犯罪偵查工作的方法,更好地打擊職務(wù)犯罪。
[Abstract]:This article mainly studies the investigation method of the duty crime of the state staff. First, it studies the concept and characteristics of the duty crime, the content of the investigation of the duty crime, the characteristics and functions of the investigation method of the duty crime and the principles that should be followed. Secondly, it is also the most important part of this article, which is divided into economic crimes such as bribery and bribery. The study of the investigation method of the case and the investigation method of the crime of dereliction of duty are studied in detail on the investigation methods of corruption, bribery, misappropriation of public funds, the private division of state assets, the unidentified sources of huge property, neglect of duty, abuse of duty, misuse of power and the practice of favoritism and perverting the law, and through research and practical cases of procuratorial work, each kind of investigation can be better understood. Crime is unique, different from other crime investigation, pretrial, forensics and other investigation methods; finally, the investigation of the difficulties and Countermeasures of the job crime investigation work, the purpose is to face difficulties and have a good number of minds, to find more conducive to the job of crime detection methods, better to combat job crime.
