【摘要】：警察職業(yè)道德是警察在操作和行使警察權(quán)力的過(guò)程中所形成的道德意識(shí)、道德規(guī)范以及道德行為實(shí)踐的總和。警察作為一個(gè)特殊的職業(yè)群體,依靠國(guó)家公共權(quán)力為基礎(chǔ),代表國(guó)家執(zhí)行權(quán)力,其職業(yè)道德的核心是“權(quán)力道德”。加強(qiáng)警察職業(yè)道德建設(shè),從國(guó)家、社會(huì)和警察自身的角度講都具有重要意義。當(dāng)今社會(huì),警察職業(yè)道德問(wèn)題越來(lái)越受到廣泛關(guān)注,職業(yè)道德建設(shè)的種種不足導(dǎo)致了警察自身道德的缺失,從而引發(fā)了社會(huì)對(duì)警察隊(duì)伍的信任危機(jī)。本文在深入剖析警察職業(yè)道德建設(shè)存在問(wèn)題及原因的基礎(chǔ)上,探尋了加強(qiáng)警察職業(yè)道德建設(shè)的有效途徑,提出了一些解決問(wèn)題的方法。特別是,對(duì)于當(dāng)前警察職業(yè)道德建設(shè)存在問(wèn)題的原因,本文從思想認(rèn)識(shí)、社會(huì)經(jīng)濟(jì)、文化、警察職業(yè)內(nèi)部建設(shè)等方面進(jìn)行了較為深入的剖析;對(duì)于警察職業(yè)道德建設(shè)的實(shí)踐路徑,本文立足當(dāng)前實(shí)際進(jìn)行了較為詳細(xì)的闡述,具有一定的操作性和現(xiàn)實(shí)參閱性。 全文共分為三大部分。第一部分闡述了警察職業(yè)道德建設(shè)的內(nèi)涵及其意義。警察職業(yè)道德以國(guó)家權(quán)力為核心,本質(zhì)上是一種“權(quán)力道德”,因此,具有政治性、約束性和示范性的特點(diǎn)。警察職業(yè)道德建設(shè)就是指通過(guò)有組織有計(jì)劃的系統(tǒng)教育、有效的法律規(guī)范約束及警察自身的道德修養(yǎng)和實(shí)踐等途徑,將道德規(guī)范的各種要求內(nèi)化為警察自身的道德觀念和道德需求,從而提高警察的職業(yè)道德修養(yǎng),樹(shù)立警察高尚的道德品質(zhì)、道德情感、職業(yè)情操和職業(yè)理想信念,養(yǎng)成良好的職業(yè)道德習(xí)慣以及自覺(jué)的職業(yè)道德行為的過(guò)程。加強(qiáng)警察職業(yè)道德建設(shè)具有三方面的重要意義:有利于提升國(guó)家公共權(quán)力的形象;是構(gòu)建社會(huì)主義和諧社會(huì)的需要;有利于提高警察自身的職業(yè)素質(zhì)。 第二部分分析了警察職業(yè)道德建設(shè)的現(xiàn)狀,并剖析了存在問(wèn)題的原因。警察職業(yè)道德建設(shè)主流良好,廣大人民警察在社會(huì)主義現(xiàn)代化建設(shè)中發(fā)揮了重要作用,為社會(huì)主義事業(yè)的發(fā)展進(jìn)步做出了積極貢獻(xiàn)。職業(yè)道德建設(shè)存在的主要問(wèn)題有:首先,道德規(guī)范體系還不夠完善。如規(guī)范制度不健全、缺乏針對(duì)性和可操作性,沒(méi)有和警察的切身利益掛鉤,缺乏約束力度,責(zé)任落實(shí)不徹底等。其次,監(jiān)督機(jī)制有待進(jìn)一步健全。內(nèi)部警務(wù)督察制度和外部國(guó)家權(quán)力機(jī)關(guān)、社會(huì)群眾、輿論的監(jiān)督需進(jìn)一步加強(qiáng)。再次,職業(yè)道德教育不夠深入。主要表現(xiàn)在教育方式上重灌輸,輕教育;道德榜樣的力量沒(méi)有得到很好的發(fā)揮;保障制度不落實(shí)導(dǎo)致民警缺乏提高道德修養(yǎng)的自覺(jué)性。第四,道德建設(shè)存在的諸多問(wèn)題導(dǎo)致了警察自身道德的缺失,歸結(jié)起來(lái)表現(xiàn)在缺乏對(duì)群眾的責(zé)任感、對(duì)法律的正義感、對(duì)自身的榮譽(yù)感。道德建設(shè)存在的問(wèn)題有著深刻的社會(huì)、經(jīng)濟(jì)、文化原因,主要原因有:第一,從總體上對(duì)警察職業(yè)道德建設(shè)的重視程度不夠,一些公安機(jī)關(guān)只顧抓業(yè)務(wù),忽視了隊(duì)伍的思想建設(shè)。第二,市場(chǎng)經(jīng)濟(jì)對(duì)警察職業(yè)道德建設(shè)的沖擊。市場(chǎng)經(jīng)濟(jì)機(jī)制帶來(lái)的片面金錢化、利益化的傾向,追求功利等與道德法則的差異以及對(duì)道德約束力的弱化,對(duì)道德建設(shè)形成了沖擊。第三,中國(guó)傳統(tǒng)文化對(duì)警察道德建設(shè)的影響。傳統(tǒng)文化中的“皇權(quán)觀念”和“人情社會(huì)”的社會(huì)關(guān)系的傳統(tǒng)特點(diǎn)對(duì)警察職業(yè)道德建設(shè)產(chǎn)生負(fù)面影響。第四,警察職業(yè)內(nèi)部建設(shè)的不完善對(duì)道德建設(shè)形成制約。警察錄用制度不嚴(yán)、公安管理體制不順暢、立法和司法制度不完善等內(nèi)部建設(shè)存在的問(wèn)題,對(duì)道德建設(shè)構(gòu)成了制約。 第三部分闡述了警察職業(yè)道德建設(shè)的路徑。第一,完善警察職業(yè)道德規(guī)范體系。主要是健全警察職業(yè)道德制度措施、深化規(guī)范權(quán)力的運(yùn)行,促進(jìn)警察職業(yè)道德和法律的結(jié)合。第二,加強(qiáng)警察職業(yè)道德教育。加強(qiáng)警察職業(yè)道德教育的重點(diǎn)是要教育廣大民警忠于祖國(guó),樹(shù)立強(qiáng)烈的愛(ài)國(guó)意識(shí);忠于人民,樹(shù)立全心全意為人民服務(wù)的意識(shí);忠于法律,樹(shù)立公正執(zhí)法的意識(shí);終于本職工作,樹(shù)立愛(ài)崗敬業(yè)的思想。警察職業(yè)道德建設(shè)實(shí)現(xiàn)的路徑主要有組織學(xué)習(xí),加強(qiáng)警察道德規(guī)范的認(rèn)知教育;強(qiáng)化學(xué)校教育和在職教育;加強(qiáng)民警道德習(xí)慣的養(yǎng)成。第三,提高警察職業(yè)道德修養(yǎng)的自覺(jué)性,人民警察應(yīng)當(dāng)從自重、自省、自警、自勵(lì)入手,將道德規(guī)范的外在約束力變?yōu)閮?nèi)在的積極需求,提高道德修養(yǎng)的自覺(jué)性。第四,強(qiáng)化人民警察職業(yè)道德行為的監(jiān)督。一方面,通過(guò)建立有力的內(nèi)部督察隊(duì)伍,健全、平衡各部門之間的相互監(jiān)督,形成長(zhǎng)效機(jī)制來(lái)完善內(nèi)部監(jiān)督;另一方面,通過(guò)強(qiáng)化國(guó)家權(quán)力機(jī)關(guān)的監(jiān)督,保持司法機(jī)關(guān)權(quán)力的制約平衡,加強(qiáng)群眾監(jiān)督、輿論監(jiān)督,從而完善外部監(jiān)督,實(shí)現(xiàn)對(duì)警察職業(yè)道德行為的全面有效的監(jiān)督。
[Abstract]:Police professional morality is the sum of moral consciousness, moral norms and moral behavior practice formed by the police in the process of operating and exercising police power. As a special professional group, the police rely on the state's public power as the basis and represent the state to execute power. The core of the professional ethics is "power morality". The construction of professional ethics is of great significance from the point of view of the state, society and the police themselves. Nowadays, the problem of police professional ethics has been paid more and more attention. The shortcomings of the construction of professional ethics have led to the lack of the police's own morality, which has caused the crisis of trust in the police force. This article is in depth analysis of the police. On the basis of the problems and reasons for the construction of professional ethics, this paper explores the effective ways to strengthen the construction of police professional ethics, and puts forward some methods to solve the problems. In particular, the reasons for the problems in the construction of the current police professional ethics are carried out from the aspects of ideological understanding, social economy, culture, and the internal construction of the police profession. For the in-depth analysis, for the practical path of the police professional ethics construction, this paper has a more detailed exposition based on the current practice, and has a certain operability and practical reading.
The full text is divided into three parts. The first part expounds the connotation and significance of the construction of the police professional ethics. The police professional ethics is based on the state power and is essentially a kind of "power morality". Therefore, it has the characteristics of political, restrictive and demonstrative. Education, effective legal norms and constraints, and the police's own moral cultivation and practice, etc., to internalize the various requirements of the moral norms into the moral concepts and moral needs of the police themselves, so as to improve the professional moral cultivation of the police, establish the high moral quality of the police, the moral feeling, the professional sentiment and the professional ideals and beliefs. The process of professional moral habits and conscious professional moral behavior. It is of three important significance to strengthen the construction of the police professional ethics: it is beneficial to the promotion of the image of the state's public power, the need for the construction of a harmonious socialist society, and the improvement of the professional quality of the police itself.
The second part analyses the present situation of the construction of the police's professional ethics, and analyzes the reasons for the problems. The main mainstream of the construction of the police professional ethics is good. The majority of the people's police play an important role in the socialist modernization drive and make a great contribution to the development and progress of the socialist cause. The main problems of the construction of the professional ethics are the main problems. First, the moral standard system is not perfect. For example, the standard system is not perfect, lack of pertinence and maneuverability, lack of connection with the vital interests of the police, lack of restraint and complete responsibility. Secondly, the supervision mechanism needs to be further perfected. Further strengthen the governor. Again, the vocational moral education is not deep enough. The main performance is to inculcate in the way of education, to light education; the strength of moral example is not well developed; the security system is not implemented, which leads to the lack of consciousness of the police to improve moral cultivation. Fourth, the problems existing in the construction of morality lead to the moral of the police itself. The lack of it is attributed to the lack of sense of responsibility to the masses, the sense of justice to the law, and the sense of honor to itself. There are profound social, economic and cultural reasons for the problems of moral construction. The main reasons are as follows: first, the overall view of the construction of police professional ethics is not enough, and some public security organs have only paid attention to the business and ignored the team. Second, the impact of the market economy on the construction of police professional ethics, the one-sided monetization of the market economy, the tendency of interest, the difference between the pursuit of utility and moral law and the weakening of the moral binding force. Third, the influence of Chinese traditional culture on the construction of police morality. The traditional characteristics of the "imperial power concept" and "human society" in the traditional culture have a negative influence on the construction of the police professional ethics. Fourth, the imperfect internal construction of the police has formed a restriction on the moral construction. The system of police employment is not strict, the public security management system is not smooth, and the legislation and judicial system are not perfect. The problems that exist constitute a constraint on the construction of morality.
The third part elaborated the path of the police professional ethics construction. First, improve the police professional ethics system. It is mainly to improve the police professional moral system measures, deepen the operation of the standard power, promote the combination of police professional morality and law. Second, strengthen the police professional moral education. To educate the majority of the police to be loyal to the motherland, to establish a strong sense of patriotism, to be loyal to the people, to set up a sense of serving the people wholeheartedly, to be loyal to the law, to set up a sense of impartial law enforcement, to finally work and to set up the thought of loving the post. The path of the realization of the police professional ethics is mainly organized to learn and strengthen the cognition of the moral standards of the police. Education; strengthen school education and on-the-job education; strengthen the cultivation of moral habits of police. Third, improve the consciousness of police professional moral cultivation, the people's police should start from self weight, self-examination, self policing and self encouragement, turn the external binding force of moral norms into internal positive demand, improve the consciousness of moral cultivation. Fourth, strengthen the people's police. On the one hand, through the establishment of a strong team of internal inspectors, perfect and balanced supervision between various departments to form a long-term mechanism to improve internal supervision; on the other hand, through strengthening the supervision of the state authority, maintaining the balance of the power of the judiciary, strengthening the supervision of the masses, supervision by public opinion, and thus perfecting the supervision. External supervision to achieve comprehensive and effective supervision of police professional ethics.
