【摘要】：職務(wù)犯罪問題一直是困擾各國政府的痼疾,也是普通民眾乃至高層領(lǐng)導(dǎo)的聚焦。職務(wù)犯罪是指具有一定職務(wù)身份的人故意或過失地實(shí)施了與其職務(wù)之間有必然聯(lián)系的,侵犯了國家管理公務(wù)的職能和聲譽(yù),致使國家和人民利益遭受重大損失的各種犯罪的總稱。當(dāng)前,職務(wù)犯罪不僅嚴(yán)重?fù)p害了國家和人民的利益,影響我國經(jīng)濟(jì)的健康發(fā)展,而且嚴(yán)重?fù)p害了黨和政府在人民群眾心目中的地位。因此,深入研究和探討職務(wù)犯罪問題對于開展反腐敗斗爭有著十分重要的現(xiàn)實(shí)意義。本文考察了我國職務(wù)犯罪的歷史和現(xiàn)狀,總結(jié)了聯(lián)合國、歐盟等國際組織及我國香港地區(qū)遏制職務(wù)犯罪的成功經(jīng)驗(yàn),并在剖析其成因和特點(diǎn)的基礎(chǔ)上,有針對陛的提出了我國職務(wù)犯罪的預(yù)防對策和偵查策略。最后提出了在我國現(xiàn)實(shí)條件下預(yù)防和偵查職務(wù)犯罪的一系列具體構(gòu)想和建議。 本文除引言和結(jié)束語外,共分為三個部分。 第一部分為我國職務(wù)犯罪的歷史與現(xiàn)狀。文章首先回顧了夏、商、周、戰(zhàn)國、秦漢、唐、宋、明、清時期的職務(wù)犯罪概況并簡單地概括了我國古代職務(wù)犯罪的特點(diǎn)。其次介紹了我國職務(wù)犯罪的現(xiàn)狀,即我國現(xiàn)階段職務(wù)犯罪呈現(xiàn)的狀態(tài):①犯罪主體發(fā)案率高;②窩案、串案增多;③高級干部職務(wù)犯罪凸現(xiàn);④職務(wù)犯罪人員外逃、資金外流嚴(yán)重。最后分析了我國職務(wù)犯罪的發(fā)展態(tài)勢并分析了入世后我國職務(wù)犯罪將在諸多方面發(fā)生的變化:①主體成份趨向多元化;②利用資源趨向信息化;③種類趨向多樣化;④手段更加隱蔽化。 第二部分為職務(wù)犯罪的成因、危害及預(yù)防對策。首先論述了我國職務(wù)犯罪的成因,分別從理論方面和我國轉(zhuǎn)型這一特殊時期的狀況來加以闡述,并在此基礎(chǔ)上分析了職務(wù)犯罪造成的危害,認(rèn)為職務(wù)犯罪會造成以下危害:①動搖政權(quán)根基,沖擊社會穩(wěn)定;②妨害社會財富合理分配;③阻礙市場經(jīng)濟(jì)秩序的建立;④影響經(jīng)濟(jì)決策及政策的制定和執(zhí)行。其次介紹了聯(lián)合國、歐盟等國際組織以及香港廉政公署預(yù)防職務(wù)犯罪的措施及對我國職務(wù)犯罪預(yù)防的啟示。最后闡述了我國職務(wù)犯罪的預(yù)防對策及其完善的設(shè)想。關(guān)于我國職務(wù)犯罪的預(yù)防策略,分別從職務(wù)犯罪的刑事對策和建立職務(wù)犯罪預(yù)防法律制度兩個方面加以剖析;關(guān)于我國職務(wù)犯罪預(yù)防的建
[Abstract]:The problem of duty crime has always been the chronic disease of governments, and also the focus of ordinary people and even senior leaders. Job-related crime refers to a person with certain official status who intentionally or negligently carries out an inevitable connection with his position, thus infringing upon the functions and reputation of the state in the management of public affairs. The sum of various crimes that cause great losses to the interests of the state and the people. At present, job-related crimes not only seriously damage the interests of the country and the people, affect the healthy development of our economy, but also seriously damage the position of the Party and the government in the eyes of the people. Therefore, it is of great practical significance to study and discuss the problem of duty crime for the fight against corruption. This paper reviews the history and present situation of duty crime in China, summarizes the successful experiences of international organizations such as the United Nations, the European Union and Hong Kong, and analyzes its causes and characteristics. The author puts forward the preventive countermeasures and investigation strategies for duty crime in China. Finally, a series of concrete ideas and suggestions on the prevention and investigation of job-related crimes in China are put forward. In addition to the introduction and conclusion, this article is divided into three parts. The first part is the history and present situation of duty crime in our country. This paper first reviews the general situation of duty crimes in Xia, Shang, Zhou, warring States, Qin and Han dynasties, Tang, Song, Ming and Qing dynasties, and briefly summarizes the characteristics of ancient duty crimes in China. Secondly, it introduces the present situation of duty crime in our country, that is, the present situation of duty crime in our country, that is, the occurrence rate of crime subject at 1: 1 is high, and the number of cases is increased. Secondly, the paper introduces the measures of preventing duty crime in international organizations such as the United Nations, European Union and Hong Kong Independent Commission against Corruption, and the enlightenment to the prevention of duty crimes in China. At last, the paper expounds the preventive measures and the perfect assumption of duty crime in our country. The prevention strategy of duty crime in our country is analyzed from two aspects: the criminal countermeasures of duty crime and the establishment of legal system of duty crime prevention; on the establishment of duty crime prevention in our country
