【摘要】： 我國的出入境管理是國家對中國公民和外國人出入境及與之相關(guān)的事務(wù)行使管轄權(quán)的一種法律行為,是出入境管理主管機(jī)關(guān)對出入境活動實施的調(diào)節(jié)和控制,它是國家涉外管轄的一個組成部分,對維護(hù)國家主權(quán)、安全和利益,保障中外公民的合法權(quán)益,促進(jìn)中國與各國的政治、經(jīng)濟(jì)、文化交往,具有十分重要的意義。 50多年以來,隨著國家政治、經(jīng)濟(jì)形勢的發(fā)展和變化以及與世界各國友好交往的需要,我國的出入境管理法律、政策也經(jīng)歷了一個發(fā)展變化的過程,中央政府先后制定了一系列出入境管理法律、法規(guī),并逐步在中央及地方都設(shè)置了出入境管理機(jī)構(gòu),逐漸建立了具有中國特色的出入境管理制度。 隨著社會的不斷進(jìn)步,我國的出入境管理制度一些不適應(yīng)的方面也逐漸顯現(xiàn),尤其是出入境法律法規(guī)的缺陷和出入境管理體制的弊端,很大程度上限制了出入境管理在國家對外開放和交流中應(yīng)有優(yōu)勢的發(fā)揮。 因此,本文配合我國出入境管理法律制度實踐的需求,對照境外出入境管理法律制度,剖析我國出入境管理立法和行政執(zhí)法的現(xiàn)狀與不足,系統(tǒng)全面地對出入境管理法律制度進(jìn)行積極思考和綜合分析,并探討使其完善與重構(gòu)的途徑。
[Abstract]:Exit and entry management in China is a legal act to exercise the jurisdiction of China citizens and foreigners immigration and national affairs related to the immigration authorities is to regulate and control the implementation of the immigration activities, it is a part of the national jurisdiction, to safeguard national sovereignty, security and Chinese and foreign interests, safeguard the legitimate rights and interests of citizens, promote Chinese and national political, economic, and cultural exchanges, it has very important significance.
For over 50 years, with the country's political and economic situation of the development and change and the need of friendly exchanges with all countries in the world, China's immigration law, the policy has also experienced a process of development, the central government has formulated a series of immigration laws, regulations, and gradually in the central and local settings the immigration management agencies, gradually established immigration management system with China characteristics.
With the progress of society, immigration management system in our country some unsuitable also gradually, especially the defects of the immigration laws and regulations and immigration management system, largely limits the entry and exit management should have advantages in opening up the country and exchange in the play.
Therefore, this paper combined with the practice of China's entry and exit legal system needs to control the overseas legal system for immigration management, analysis of China's current entry exit administrative legislation and administrative law enforcement and the lack of systematic and comprehensive on legal system for immigration management of positive thinking and comprehensive analysis, and explore the way of improving and reconstruction.
