【摘要】：近年來,我國非公有制企業(yè)的地位和影響力日益增強,與此同時,我們也發(fā)現(xiàn)這些企業(yè)的違法犯罪問題同樣日趨嚴重,急待我們對此做出探討。在西方犯罪學(xué)中,這一領(lǐng)域的研究歸屬于白領(lǐng)犯罪學(xué)的范圍,而與其它類型的白領(lǐng)犯罪相比,非公有制企業(yè)犯罪具有其自身的特殊性,這一領(lǐng)域的研究仍有許多值得發(fā)掘的地方。因此對非公有制企業(yè)犯罪問題進行研究我們認為是具有理論意義和現(xiàn)實意義的。另外,對于犯罪成因的研究,通常被認為是犯罪研究中最為重要的一環(huán),因為在現(xiàn)象既存的情況下,尋找到其成因,也正是犯罪的防治得以進行的前提,因此本文的研究主要集中在對于成因的探討。 本文主要借鑒西方犯罪學(xué)的研究成果,將犯罪原因的概念分為犯罪傾向與犯罪行為兩個層面,認為犯罪傾向只是提供一種可能性,須加上犯罪機會一起,才會產(chǎn)生犯罪行為。犯罪傾向的形成是社會化影響的結(jié)果,而犯罪機會則存在于社會的環(huán)境當(dāng)中。在此,我們所說的犯罪行為并不是指單個具體的人的犯罪行為,而是一種不指向特定個人意義上的更大的犯罪行為。在這樣一種框架下,我們以中國社會的結(jié)構(gòu)轉(zhuǎn)型為背景,從企業(yè)管理者犯罪傾向的形成及存在于工商業(yè)環(huán)境中的犯罪機會兩個方面入手,對我國非公有制企業(yè)犯罪的成因進行了具體的分析。
[Abstract]:In recent years, the status and influence of non-public enterprises in our country have been increasing. At the same time, we also find that the illegal and criminal problems of these enterprises are also becoming more and more serious. It is urgent for us to discuss this. In the western criminology, The research in this field belongs to the scope of white-collar criminology, and compared with other types of white-collar crime, non-public enterprise crime has its own particularity. The research in this field is still worth exploring. Therefore, we think it is of theoretical and practical significance to study the crime of non-public enterprises. In addition, the research on the causes of crime, It is generally considered as the most important part in the research of crime, because finding the cause of the crime is the premise of the crime prevention and cure, so the research of this paper mainly focuses on the discussion of the cause of the crime. This article mainly draws lessons from the western criminology research achievement, divides the crime reason concept into two levels: the criminal tendency and the criminal behavior, thinks that the criminal tendency only provides a kind of possibility, must add the crime opportunity together, The formation of criminal tendency is the result of socialized influence, and the opportunity of crime exists in the social environment. In this case, we do not mean the criminal behavior of a single specific person. But a larger crime that does not point to a particular individual. In such a framework, we take the structural transformation of Chinese society as our background. Starting with the formation of the criminal tendency of enterprise managers and the criminal opportunities in the industrial and commercial environment, the causes of non-public enterprise crime in China are analyzed in detail.
