【摘要】： 戶(hù)籍制度是世界各國(guó)都普遍實(shí)行的一項(xiàng)民事登記制度，它是政府對(duì)人民進(jìn)行登記管理一個(gè)十分基本的措施。中國(guó)的戶(hù)籍制度作為一項(xiàng)涉及全體人民的切身利益和中國(guó)社會(huì)生活的基本形貌的具有根本重要性的制度。它與13億中國(guó)人民的幾乎所有的基本權(quán)利都息息相關(guān)。戶(hù)籍制度作為一個(gè)社會(huì)制度本應(yīng)當(dāng)服務(wù)于民，方便于民。然而，我們現(xiàn)行的戶(hù)籍制度更多的是具有限制、管理和區(qū)分居民身份等級(jí)方面的功能，而較少?lài)?guó)民權(quán)益保障、社會(huì)保障的內(nèi)涵。隨著社會(huì)的不斷發(fā)展，以及人們對(duì)于自由、平等的不懈追求，存在著諸多先天性的缺陷的戶(hù)籍制度已經(jīng)暴露出越來(lái)越多的弊端�，F(xiàn)行的戶(hù)籍制度除了對(duì)國(guó)民的身份做了不公正的界定之外，在某種程度上甚至成為了有關(guān)職業(yè)、地域和身份歧視的制度性基礎(chǔ)。這與以平等為基石的現(xiàn)代社會(huì)完全格格不入。因此戶(hù)籍制度的改革不但勢(shì)在必行，而且迫在眉睫。 本文第一部分對(duì)我國(guó)歷史上的戶(hù)籍制度和我國(guó)現(xiàn)行戶(hù)籍制度的形成過(guò)程作出了簡(jiǎn)要的介紹，說(shuō)明二者之間的繼承與關(guān)聯(lián)。本文第二部分主要是介紹戶(hù)籍制度與基本法律價(jià)值之間的沖突。首先通過(guò)正義的角度對(duì)我國(guó)的戶(hù)籍制度進(jìn)行審視，并指出它與正義之間的差距所在。平等和自由是正義的兩大原則。本文分別就戶(hù)籍制度和平等、戶(hù)籍制度和自由兩個(gè)方面展開(kāi)進(jìn)一步論述，從理論和事實(shí)上闡明我國(guó)戶(hù)籍制度的種種弊端之所在。文章的第三部分主要是通過(guò)對(duì)外國(guó)和臺(tái)灣地區(qū)的戶(hù)籍管理制度的介紹，讓我們認(rèn)識(shí)到了我國(guó)戶(hù)籍制度與國(guó)際先進(jìn)管理水平的差距，也為其未來(lái)的改革提供了有益的借鑒。本文最后一部分簡(jiǎn)要的概括了我國(guó)近二十年來(lái)戶(hù)籍改革所取得的成就以及所存在的不足，，同時(shí)指出只有一元制的戶(hù)籍制度改革才是我國(guó)戶(hù)籍制度未來(lái)發(fā)展的正確方向。
[Abstract]:The household registration system is a civil registration system that is widely practiced in all countries in the world. It is a very basic measure for the government to register and manage the people. China's household registration system is a system of fundamental importance concerning the vital interests of the whole people and the basic appearance of Chinese social life. It is closely related to almost all the basic rights of the 1.3 billion Chinese people. As a social system, the household registration system should have served the people. However, our current household registration system has more functions of limiting, managing and differentiating the status of residents, while less national rights and interests protection and social security connotation. With the continuous development of society, As well as people's unremitting pursuit of freedom and equality, the household registration system, which has many inherent defects, has exposed more and more drawbacks. To some extent, it has even become the institutional basis of professional, geographical and identity discrimination, which is completely incompatible with the modern society based on equality. Therefore, the reform of the household registration system is not only imperative, but also urgent. The first part of this paper gives a brief introduction to the household registration system in the history of our country and the forming process of the current household registration system in our country. The second part of this paper mainly introduces the conflict between the household registration system and the basic legal value. And points out the gap between it and justice. Equality and freedom are the two main principles of justice. This paper further discusses the two aspects of household registration system and equality, household registration system and freedom, respectively. The third part of the article mainly through the introduction of the household registration management system in foreign countries and Taiwan region, the third part of the article is mainly through the introduction of the household registration management system in foreign countries and Taiwan. It has made us realize the gap between our household registration system and the international advanced management level. It also provides a useful reference for the future reform. The last part of this paper briefly summarizes the achievements and shortcomings of the household registration reform in China in the past 20 years. At the same time, it points out that only the reform of the household registration system is the correct direction for the future development of the household registration system in China.
