【摘要】： 加入WTO標(biāo)志著我國(guó)正深入融入經(jīng)濟(jì)全球化，由此必然對(duì)我國(guó)有組織犯罪產(chǎn)生重大影響。弄清這種影響不僅可以為設(shè)計(jì)今后的有組織犯罪的防控方略提供理論上的指導(dǎo)，做到未雨綢繆，而且可以有效地防范當(dāng)前的有組織犯罪發(fā)生質(zhì)的轉(zhuǎn)變，將其社會(huì)危害性減至最小程度。因而，探討經(jīng)濟(jì)全球化下的中國(guó)有組織犯罪演變就顯得尤為必要和重要。 從國(guó)內(nèi)外研究現(xiàn)狀來(lái)看，學(xué)者們大多側(cè)重于對(duì)有組織犯罪及其防治對(duì)策進(jìn)行研究，而對(duì)我國(guó)有組織犯罪發(fā)展研究幾乎空白。即便有個(gè)別學(xué)者對(duì)此作了研究，但其缺乏對(duì)西方發(fā)達(dá)國(guó)家經(jīng)濟(jì)全球化下的有組織犯罪作深入、細(xì)致的考察，因而，其對(duì)經(jīng)濟(jì)全球化下的中國(guó)有組織犯罪演變趨勢(shì)所作的預(yù)測(cè)顯得過(guò)于主觀，不夠科學(xué)與嚴(yán)謹(jǐn)。 為消彌這一領(lǐng)域犯罪學(xué)研究理論上的不足，本文以社會(huì)經(jīng)濟(jì)結(jié)構(gòu)變遷為透視有組織犯罪發(fā)展的窗口，在指明經(jīng)濟(jì)全球化對(duì)我國(guó)社會(huì)經(jīng)濟(jì)結(jié)構(gòu)造成種種沖擊的基礎(chǔ)上，通過(guò)對(duì)經(jīng)濟(jì)全球化與有組織犯罪二者之間存在本質(zhì)上聯(lián)系的分析，得出經(jīng)濟(jì)全球化對(duì)我國(guó)社會(huì)經(jīng)濟(jì)結(jié)構(gòu)的沖擊必然會(huì)對(duì)我國(guó)有組織犯罪產(chǎn)生重大而深刻的影響這一結(jié)論。隨后，通過(guò)對(duì)西方發(fā)達(dá)國(guó)家有組織犯罪的考察和描述性研究，在勾勒出經(jīng)濟(jì)全球化下的有組織犯罪基本輪廓的基礎(chǔ)上，運(yùn)用比較分析方法，揭示出經(jīng)濟(jì)全球化下的西方發(fā)達(dá)國(guó)家與我國(guó)有組織犯罪之間存在的共性與個(gè)性特征，，進(jìn)而據(jù)此在犯罪量、犯罪主體、犯罪組織程度、犯罪手段、犯罪形式、犯罪活動(dòng)范圍、犯罪涉獵領(lǐng)域等方面，對(duì)我國(guó)有組織犯罪演變的可能趨勢(shì)作出預(yù)測(cè)。
[Abstract]:China's entry into WTO indicates that our country is deeply integrated into economic globalization, which will inevitably have a great impact on organized crime in our country. Understanding this influence can not only provide theoretical guidance for the design of the strategy of prevention and control of organized crime in the future. So it is necessary and important to explore the evolution of organized crime in China under the economic globalization. From the point of view of the current research situation at home and abroad, most scholars focus on organized crime and its prevention and control measures, while the research on the development of organized crime in China is almost blank. However, it lacks of a thorough and careful investigation of the organized crime under the economic globalization of the western developed countries. Therefore, its prediction of the evolution trend of organized crime in China under the economic globalization appears to be too subjective, not scientific and rigorous. In order to eliminate the theoretical deficiency of criminology research in this field, this paper takes the change of social economic structure as the window of the development of organized crime, on the basis of pointing out the impact of economic globalization on the social and economic structure of our country. Based on the analysis of the essential relationship between economic globalization and organized crime, it is concluded that the impact of economic globalization on China's social and economic structure will inevitably have a significant and profound impact on China's organized crime. Based on the investigation and descriptive study of organized crime in western developed countries, and on the basis of outlining the basic outline of organized crime under the economic globalization, the comparative analysis method is used. It reveals the commonness and individuality between the western developed countries and our country's organized crime under the economic globalization, and according to this, it can be concluded that the amount of crime, the subject of crime, the degree of criminal organization, the means of crime, the form of crime, the scope of criminal activity, and so on. This paper predicts the possible trend of the evolution of organized crime in China.
