【摘要】：黑社會(huì)犯罪是一種國(guó)際社會(huì)公認(rèn)的有組織犯罪最高形態(tài)，被聯(lián)合國(guó)大會(huì)宣稱為“全球性的瘟疫”、“世界三大犯罪災(zāi)難之一”。目前，“各國(guó)和國(guó)際上有組織的犯罪活動(dòng)不斷加劇的趨勢(shì)引起了發(fā)達(dá)國(guó)家和發(fā)展中國(guó)家的政府和人民的嚴(yán)重關(guān)切和震驚�！蔽覈�(guó)刑法第294條中“黑社會(huì)性質(zhì)組織”是新刑法典創(chuàng)制的概念，是立法機(jī)關(guān)基于在我國(guó)明顯的、典型的黑社會(huì)還沒有出現(xiàn)，但橫行一方、欺壓百姓的有組織犯罪時(shí)有出現(xiàn)而創(chuàng)制的。最高人民法院在2000年全國(guó)“打黑除惡”專項(xiàng)斗爭(zhēng)前夕專門制定了對(duì)于刑法第294條的司法解釋，，但對(duì)于黑社會(huì)性質(zhì)犯罪的認(rèn)定和處理仍然是刑事犯罪研究的一個(gè)重點(diǎn)和難點(diǎn)。因此，加強(qiáng)對(duì)黑社會(huì)性質(zhì)組織犯罪的理論研究，并用以指導(dǎo)司法實(shí)踐對(duì)黑社會(huì)性質(zhì)組織犯罪的正確處理以及完善黑社會(huì)性質(zhì)犯罪的相關(guān)刑事立法具有重要的意義。本論文將刑法學(xué)、犯罪學(xué)和刑事政策學(xué)的內(nèi)容糅合在一起，探討了黑社會(huì)性質(zhì)組織的概念和特征，而且在此基礎(chǔ)上進(jìn)一步分析了與之相關(guān)概念的界限；分析了其產(chǎn)生的原因，并提出了遏制黑社會(huì)性質(zhì)組織犯罪的對(duì)策和建議。
[Abstract]:Underworld crime is the highest form of organized crime recognized by the international community. Declared by the United Nations General Assembly as "a global plague" and "one of the three major criminal catastrophes in the world"... at present, "the increasing trend of organized crime in various countries and internationally has aroused governments and people in both developed and developing countries." The grave concern and shock of the people. "Article 294 of the Criminal Code of our country," the concept of "underworld organization", which was created in the new Criminal Code, It is the legislature based on the obvious, typical underworld that has not yet appeared in our country, but it is rampant. Organized crime that oppresses the people has been created from time to time. In 2000, the Supreme people's Court formulated a judicial interpretation of Article 294 of the Criminal Law on the eve of the nationwide special struggle to "crack down on crime and eliminate evil". However, the identification and handling of gangland crimes is still an important and difficult point in the study of criminal offenses. Therefore, we should strengthen the theoretical research on organized crimes of underworld nature. It is of great significance to guide the judicial practice to deal with the organized crime with the nature of the underworld and to perfect the relevant criminal legislation of the crime with the nature of the underworld. This paper combines the contents of criminal law, criminology and criminal policy, and puts together the contents of criminal law, criminology and criminal policy. This paper probes into the concept and characteristics of the underworld organization, and on this basis further analyzes the limits of the related concepts, analyzes the causes of its emergence, and puts forward some countermeasures and suggestions to curb the organized crime of the underworld nature.
