【摘要】： 近年來,警察權利受到侵犯的現(xiàn)象越來越嚴重,已發(fā)展成為國家和社會必須面對和解決的問題。解決這個問題的關鍵就是要對警察權利的內(nèi)涵和外延進行準確的定性,正確的認識和區(qū)分警察權利和警察權力這兩個不同的概念,改變傳統(tǒng)的人權理論中,把警察作為人權的對立面加以約束的狀況。 通過對警察生存現(xiàn)狀的實證考察,我們發(fā)現(xiàn),作為群眾“保護者”的警察正承受著巨大的壓力:執(zhí)法過程中遭受襲擊、辱罵、威脅的情況時有發(fā)生;非警務活動過多,群眾不予理解和支持;工作繁重,休息權得不到保障,與家人聚少離多,這些都導致我國警察尤其是基層一線警察的身體健康狀況受損,心理出現(xiàn)問題,家庭生活受到影響。分析警察的生存現(xiàn)狀,我們可以找到警察權利受到侵犯的原因:首先是立法保障、體制方面的問題導致警察的執(zhí)法硬環(huán)境不佳;其次某些不準確的輿論導向和群眾對法律的認知不夠?qū)е戮斓膱?zhí)法軟環(huán)境也不夠好;再次是需要國家關注的警察“高付出、低回報”問題;當然還有警察自身素質(zhì)等等原因。 加強對警察權利的保護,可以從以下幾方面入手:一是完善法律法規(guī)和相關制度,給予警察執(zhí)法提供足夠的法律保護;二是依法合理使用警力,加強政府各部門的聯(lián)動協(xié)調(diào),使警察從繁瑣的非警務活動中解放出來;三是把握輿論導向,給警察營造一個良好的執(zhí)法環(huán)境;四是給予警察隊伍足夠的經(jīng)費保障,適當提高待遇,保持警察的平衡心理;五是從嚴治警,提高警察素養(yǎng)和執(zhí)法技能,努力營造一個和諧的警民關系。
[Abstract]:In recent years, the phenomenon that the police rights have been violated is more and more serious, which has developed into a problem that the state and society must face and solve. The key to solve this problem is to accurately define the connotation and extension of the police rights. To correctly understand and distinguish the two different concepts of police power and police power, to change the traditional theory of human rights, the police as the opposite of human rights to restrict the situation. Through an empirical study of the existence of the police, we find that the police, as "protectors" of the masses, are under great pressure: attacks, insults and threats occur from time to time in the course of law enforcement, and there are too many non-police activities. The masses do not understand and support; the heavy work, the lack of protection of the right to rest, and the small number of people gathered together with their families have all led to damage to the physical health and psychological problems of our country's police officers, especially the first-line police officers at the grass-roots level. Family life is affected. By analyzing the existing situation of the police, we can find out the reasons for the violation of the police rights: firstly, the legislation guarantees, the system problems lead to the poor enforcement environment of the police; Secondly, some inaccurate public opinion guidance and the people's insufficient understanding of the law also lead to the police enforcement soft environment is not good enough; again, the police need to pay attention to the problem of "high pay, low return"; of course, there are reasons such as the quality of the police themselves. To strengthen the protection of police rights, we can start from the following aspects: first, to improve laws, regulations and related systems to provide adequate legal protection for police law enforcement; and second, to make rational use of police forces in accordance with the law, and to strengthen the coordination between various government departments. The third is to grasp the guidance of public opinion, to create a good law enforcement environment for the police, to give adequate financial protection to the police force, to properly improve the treatment, and to maintain the balanced psychology of the police. Fifth, strict management of police, improve police literacy and law enforcement skills, and strive to create a harmonious relationship between the police and the people.
