【摘要】:司法鑒定制度作為我國(guó)司法制度的重要組成部分,,與訴訟制度、證據(jù)制度相互交融。隨著司法理念的轉(zhuǎn)變、訴訟結(jié)構(gòu)的調(diào)整以及法治的進(jìn)步,其已由傳統(tǒng)的鑒定“權(quán)力”轉(zhuǎn)為鑒定“服務(wù)”,并成為一項(xiàng)重要的司法“保障”制度,體現(xiàn)了現(xiàn)代法治對(duì)當(dāng)事人訴訟權(quán)利的尊重。而司法鑒定機(jī)構(gòu)作為司法鑒定制度中的實(shí)施制度、管理制度及適用制度的重要主體角色游走于靜態(tài)管理與動(dòng)態(tài)執(zhí)業(yè)兩大場(chǎng)域,發(fā)揮著化解社會(huì)矛盾、保障當(dāng)事人訴權(quán)的關(guān)鍵作用。但在歷經(jīng)四次變革后,仍舊處于實(shí)施程序混亂、管理主體混亂、執(zhí)業(yè)范圍混亂的局面。其根本原因在于:四次變革圍繞的中心均為公、檢、法、司四大機(jī)關(guān)的權(quán)力分配,而非司法鑒定機(jī)構(gòu)權(quán)利的保障。司法鑒定機(jī)構(gòu)在司法實(shí)踐中面臨種種難題,使其自身難以健康、協(xié)調(diào)、可持續(xù)發(fā)展,更加難以承擔(dān)其應(yīng)有的服務(wù)與保障重任。為實(shí)現(xiàn)司法鑒定機(jī)構(gòu)自身的生存發(fā)展與提供優(yōu)質(zhì)鑒定服務(wù)的雙贏目的,有必要對(duì)司法鑒定機(jī)構(gòu)的權(quán)利予以足夠重視與充分保障。本文選題正是基于此而得,以期通過相應(yīng)對(duì)策對(duì)司法鑒定機(jī)構(gòu)在實(shí)踐中存在的突出問題予以解決,從而達(dá)到保障其權(quán)利的目的。 本文共分3個(gè)部分: 第一章作為司法鑒定機(jī)構(gòu)的概述,首先對(duì)司法鑒定機(jī)構(gòu)在司法鑒定制度的實(shí)施制度、管理制度以及適用制度中進(jìn)行角色定位,為全文的論述奠定角色框架基礎(chǔ)。然后對(duì)我國(guó)司法鑒定機(jī)構(gòu)在歷經(jīng)四次改革之后的現(xiàn)狀予以梳理,闡述了鑒定機(jī)構(gòu)的實(shí)施現(xiàn)狀、管理現(xiàn)狀和執(zhí)業(yè)現(xiàn)狀。最后在對(duì)市場(chǎng)經(jīng)濟(jì)體制下的兩大鑒定機(jī)構(gòu)主體——職權(quán)鑒定機(jī)構(gòu)和社會(huì)鑒定機(jī)構(gòu)進(jìn)行扼要介紹的基礎(chǔ)上,著重論述我國(guó)司法鑒定機(jī)構(gòu)權(quán)利保障的狀況及司法實(shí)踐中存在的設(shè)立難、運(yùn)營(yíng)難(實(shí)施難、管理難、執(zhí)業(yè)難)、發(fā)展難等一系列突出問題。 本文的第二章“司法鑒定機(jī)構(gòu)權(quán)利保障的理論基礎(chǔ)”中,第一節(jié)引用若干典型案例對(duì)司法鑒定機(jī)構(gòu)的四大基本性質(zhì)進(jìn)行實(shí)證分析,繼而對(duì)四大鑒定機(jī)構(gòu)的各自權(quán)利特點(diǎn)進(jìn)行理論分析。第二節(jié)展開闡述了司法鑒定機(jī)構(gòu)五項(xiàng)權(quán)利的具體內(nèi)容。第三節(jié)從司法鑒定機(jī)構(gòu)在鑒定實(shí)施制度、管理制度、適用制度中的三種角色定位出發(fā),綜合分析司法鑒定機(jī)構(gòu)權(quán)利保障的重要價(jià)值。 本文的末章“司法鑒定機(jī)構(gòu)權(quán)利保障的對(duì)策”中,通過行政管理對(duì)策解決協(xié)調(diào)發(fā)展、鑒定費(fèi)用等管理問題;通過司法對(duì)策解決安全保障和“二次準(zhǔn)入”等執(zhí)業(yè)問題;通過立法對(duì)策解決鑒定機(jī)構(gòu)設(shè)立以及鑒定機(jī)構(gòu)之訴等設(shè)立、實(shí)施問題。最后就我國(guó)司法鑒定機(jī)構(gòu)的發(fā)展權(quán)利保障提出關(guān)于發(fā)展體制、發(fā)展模式等若干完善建議。
[Abstract]:The system of judicial identification as an important part of the judicial system in China, and the litigation system, evidence system integration. With the transformation of judicial idea, litigation structure adjustment and the progress of the rule of law, which has been identified by the "power" to the traditional identification of "service", and became an important judicial guarantee the system embodies the modern rule of law, respect for the rights of parties to litigation. But the judicial authentication institutions as the implementation of the system of judicial identification system in the main body of management system and application system of the role of wandering in the static and dynamic management practice of two major fields, plays a key role in resolving social conflicts, safeguard the litigant right. But after four times after the reform, still in the implementation of the program management of the main confusion, confusion, scope of practice of chaos. The reason is that the four revolution around the center for public inspection, law, division four The distribution of power organs, rather than the judicial authentication institutions and rights protection. The judicial authentication institutions facing difficulties in the judicial practice, it is difficult to make their own health, coordination, sustainable development, more difficult to bear the service and guarantee proper responsibility. Construct their own survival and development and provide quality services in order to achieve the purpose of identification of judicial win-win identification of machine, it is necessary for the judicial authentication institutions the right to pay enough attention to and fully guarantee. This paper is derived based on this, the corresponding countermeasures to solve the problems existing in the practice of judicial authentication institutions, so as to achieve the purpose of safeguarding their rights.
This article is divided into 3 parts:
The first chapter is the judicial authentication institutions, first of all to the implementation of the system of judicial authentication institutions in the judicial system and the role of management system and the application system, lay the foundation for the role of the framework of the full text of the paper. Then the judicial appraisal institutions in China to sort out after the situation after the four reform, describes the status of implementation of identification organization, management status and practice status. Finally, based on the brief introduction of the market economic system under the authority appraisal institutions and social identification of body two identification mechanism, status and judicial practice of this paper focus on the judicial authentication institutions in China to protect the rights of the existing establishment difficult, difficult to implement, difficult operation (management is difficult, difficult, difficult to practice) the development of a series of outstanding issues.
In the second chapter the theoretical basis of the judicial authentication institutions to protect the rights of the first section cited several typical cases of judicial authentication institutions of the four basic properties of empirical analysis, theoretical analysis and the four appraisal institutions of the respective rights. Section second discusses the specific content of the judicial authentication institutions five rights. The third section from the judicial authentication institutions in the implementation of the system of identification, management system, three roles in the application system of the important value of comprehensive analysis of the judicial authentication institutions to protect the rights.
At the end of this chapter of "judicial authentication institutions rights protection countermeasures", through administrative measures to solve the coordinated development, identification of cost management problems; solve the security and the "two entry" practice problems through judicial countermeasures; through legislative countermeasures to solve the identification of institutions to set up institutions such as the establishment and identification of litigation, implementation issues. Finally on the protection of right to development of judicial authentication institutions in China put forward a development system, development mode and some suggestions.
