【摘要】：我國處于全球一體化進(jìn)程中的社會轉(zhuǎn)型期,中西文化差異、新舊道德沖突使得人類價值觀向多元化方向發(fā)展,青少年此時形成的不成熟的道德觀、人生觀、世界觀與現(xiàn)實社會環(huán)境相互作用,在個人主義和功利主義驅(qū)使下走上了違法犯罪道路。加強青少年犯罪問題研究,有助于完善青少年司法制度和法律體制建設(shè),引導(dǎo)青少年樹立正確的認(rèn)識價值、決策價值和法學(xué)價值,為綜合治理青少年違法犯罪提供了思想認(rèn)識。 現(xiàn)階段國內(nèi)外關(guān)于青少年違法犯罪的研究主要以法學(xué)、犯罪學(xué)和犯罪心理學(xué)為理論依據(jù),本文力圖綜合社會學(xué)、政治學(xué)以及思想政治教育專業(yè)的相關(guān)知識,改變以往以刑法和社會治安管理處罰條例為基礎(chǔ)的犯罪行為研究,主要從青少年的世界觀、人生觀、價值觀視角出發(fā),探究揭示新世紀(jì)以來青少年違法犯罪現(xiàn)象的發(fā)展趨勢、特征、原因以及治理措施,引導(dǎo)青少年樹立正確的人生價值觀,從而為預(yù)防、控制和減少青少年違法犯罪行為提供一些理論意見和建議。本文主要采用文獻(xiàn)研究法、定量定性分析法、系統(tǒng)科學(xué)法等研究方法,深入研究相關(guān)書籍、期刊、學(xué)位論文,在全面、準(zhǔn)確地了解文獻(xiàn)資料的基礎(chǔ)上進(jìn)行歸納總結(jié),對研究對象的“量”與“質(zhì)”進(jìn)行全面分析,揭示青少年違法犯罪問題的本質(zhì)和內(nèi)在規(guī)律,預(yù)測該研究問題的發(fā)展趨勢。 第一,青少年違法犯罪研究現(xiàn)狀及概念界定。從立法和學(xué)術(shù)方面介紹和分析了國內(nèi)外預(yù)防青少年違法犯罪問題研究的基本情況,既包括發(fā)達(dá)資本主義國家如美國和英國等國的青少年違法犯罪狀況,也論述了我國改革開放后尤其是新世紀(jì)以來青少年違法犯罪的現(xiàn)狀和發(fā)展變化。在對改革開放后我國青少年違法犯罪問題研究的理論成果進(jìn)行系統(tǒng)概括和階段性劃分的基礎(chǔ)上總結(jié)了該問題的發(fā)展趨勢。論述和比較國內(nèi)外關(guān)于“青少年”以及“青少年違法犯罪”的概念研究,并在自然意義、學(xué)理意義和法律意義等方面加以區(qū)分,從而為該問題的研究提供一個較為科學(xué)合理的基礎(chǔ)概念。 第二,青少年違法犯罪的主要特征及發(fā)展趨勢。對于青少年違法犯罪問題的研究必須結(jié)合青少年個體特征即生理與心理特點,通過對青少年身心年齡與社會環(huán)境間的矛盾、獨立性與依附性間的矛盾、活動力與自制力間的矛盾、需求與現(xiàn)實間的矛盾的研究,總結(jié)出青少年違法犯罪的總體特征：低齡化、貪婪性、團(tuán)伙性、暴力性、反復(fù)性、多樣性、智能化,并且犯罪群體日趨多元化：涉毒群體、少女群體、“性”犯罪群體、網(wǎng)絡(luò)犯罪群體以及閑散人員犯罪群體。深入了解青少年違法犯罪問題的特征與發(fā)展趨勢能夠為犯罪原因及治理措施的研究提供借鑒,有效地預(yù)防、控制和減少青少年違法犯罪。 第三,青少年違法犯罪的成因分析和治理措施研究。青少年違法犯罪的原因千差(?)、因人而異,但總體分為社會原因、家庭原因、學(xué)校教育原因以及青少年個體原因,本文力圖在綜合分析政治、經(jīng)濟(jì)、文化、社會、家庭和學(xué)校等客觀環(huán)境的基礎(chǔ)上,將著眼于青少年個體及群體的認(rèn)知、情緒、性格、動機等主觀成因,使客觀因成因與主觀成因相結(jié)合,也使青少年個體及群體在不同的家庭、學(xué)校、社會環(huán)境等客觀因素中始終堅持正確的價值觀、人生觀作為指導(dǎo)。同時針對不同的特征及成因提出相應(yīng)的治理解決措施,使其不僅成為青少年違法犯罪問題研究的落腳點,也是新理論新動態(tài)新方向研究的出發(fā)點,從而為預(yù)防青少年違法犯罪這一系統(tǒng)工程的不斷推進(jìn)提供借鑒。
[Abstract]:Our country is in the period of social transformation in the process of global integration, the differences between Chinese and Western culture, and moral conflict makes human values to diversify the direction of development, the immature teenagers moral values, outlook on life, world outlook and the interaction between the social environment and embarked on a criminal path in individualism and utilitarianism driven to strengthen the study of the problem of juvenile delinquency, help to improve the juvenile justice system and legal system construction, to guide young people to establish a correct understanding of the value of decision value and legal value, provides an idea for the comprehensive management of juvenile delinquency.
Research on juvenile delinquency at home and abroad mainly by law, Criminology and criminal psychology as the theoretical basis, this paper tries to comprehensive sociology, political science and professional knowledge of the ideological and political education, change the previous study of crime in the criminal law and the social security administration punishment were based, mainly from the young people's world outlook, the outlook on life, value view, development trend, explore the new century to reveal the phenomena of juvenile delinquency characteristics, causes and control measures, to guide young people to establish the correct values of life, so as to prevent, control and provide some theoretical opinions and suggestions to reduce juvenile delinquency behavior. This paper mainly adopts the literature research method, analysis method the quantitative and qualitative research methods, system science method, in-depth study of the relevant books, journals, dissertations, in a comprehensive, accurate understanding of the literature On the basis of data, we summarize and summarize the "quantity" and "quality" of the research object, reveal the essence and inherent law of juvenile delinquency, and predict the development trend of this research problem.
First, the present situation and the concept of crime of teenagers defined. Analyze the basic situation of research at home and abroad on the prevention of juvenile delinquency is introduced and from the legislative and academic aspects, not only including the developed capitalist countries such as the United States and Britain and other countries of the illegal status of juvenile crime, also discusses China's reform and opening up especially after the current and development of teenagers the illegal crime since the beginning of the new century. This paper summarizes the development trend of the problem based on the theoretical research results after the reform and opening up, the problem of juvenile delinquency in China were summarized and the stage division. Discussion and comparison at home and abroad on the "Youth" and "the concept of juvenile delinquency", and in the natural meaning that distinction between academic significance and legal significance and other aspects, so as to provide a more scientific and reasonable basis for this problem.
Second, the main characteristics and development trend of juvenile delinquency. To study the problem of juvenile delinquency must be combined with individual characteristics that adolescent physiological and psychological characteristics of adolescents by age and social environment between the contradictions, independence and dependence between the contradictions, the contradiction between activity and self-control, on demand between reality, summed up the general characteristics of juvenile delinquency: younger age, greed, violence, gangs, repeatability, diversity, intelligence, and criminal groups have become more diversified: drug-related groups, girl groups, "" crime groups, cyber crime groups and idle personnel in-depth understanding of criminal groups. Third, analysis of the causes of juvenile delinquency and countermeasures research. At the same time put forward the corresponding control measures to solve the characteristics and causes of different, which not only become the research on the problem of juvenile delinquency, is a new theory of the new direction of development In order to provide reference for the continuous promotion of the systematic project of juvenile delinquency in the prevention of juvenile delinquency.
