【摘要】：未成年人犯罪問題，已經(jīng)是世界的一大難題，被稱為世界第三大公害。據(jù)統(tǒng)計(jì)，未成年人犯罪已經(jīng)占到了我國(guó)每年所發(fā)刑事案件的三分之一，尤其是在中國(guó)社會(huì)正經(jīng)歷一場(chǎng)前所未有的社會(huì)轉(zhuǎn)型，互聯(lián)網(wǎng)技術(shù)日益成熟，人們的生活與互聯(lián)網(wǎng)密不可分的今天，該類犯罪有愈演愈烈之勢(shì)。未成年人犯罪是指已滿14周歲不滿18周歲的人違反刑事法律規(guī)定應(yīng)當(dāng)受到刑罰處罰的行為。通過分析這一時(shí)期未成年人犯罪的現(xiàn)狀、特征及其發(fā)展趨勢(shì)，并借鑒國(guó)內(nèi)外有關(guān)未成年人犯罪的理論研究成果，試圖找出當(dāng)前我國(guó)未成年人犯罪發(fā)生的具體原因，并針對(duì)這些原因從法律、社會(huì)、個(gè)體等不同視角研究防控未成年人犯罪的對(duì)策。 當(dāng)前未成年人犯罪的原因主要有兩個(gè)大方面。從個(gè)體原因方面來分析，包括個(gè)體生理特征因素和個(gè)體價(jià)值觀因素。從社會(huì)原因方面來分析，一是家庭的變化，包括進(jìn)城務(wù)工農(nóng)民數(shù)量不斷增加、離婚人數(shù)大幅上升導(dǎo)致了更多的離異家庭和單親家庭的出現(xiàn)與由于社會(huì)競(jìng)爭(zhēng)加劇導(dǎo)致家長(zhǎng)荒廢對(duì)子女的教育三個(gè)方面。二是社會(huì)仇恨心理的發(fā)展，，包括財(cái)富和地位的兩極分化加劇和擴(kuò)大了社會(huì)仇恨心理、經(jīng)濟(jì)利益被剝奪或侵害導(dǎo)致個(gè)人維權(quán)困難兩個(gè)方面。三是網(wǎng)絡(luò)發(fā)展帶來的不利影響，網(wǎng)絡(luò)中的負(fù)面信息對(duì)未成年人的心理產(chǎn)生影響，對(duì)未成年人傳統(tǒng)犯罪起到了一種誘因的作用。對(duì)于未成年人犯罪的防控，提出了以下對(duì)策：對(duì)于未成年人犯罪，要從法律防控、社會(huì)防控和個(gè)體防控三個(gè)方面進(jìn)行，并且應(yīng)當(dāng)以預(yù)防為主。針對(duì)實(shí)施犯罪的未成年人，不應(yīng)當(dāng)只是簡(jiǎn)單地追究刑事責(zé)任，而需要對(duì)他們的不良心理品質(zhì)進(jìn)行矯正與治療。
[Abstract]:The problem of juvenile delinquency has become a major problem in the world, which is called the third biggest public hazard in the world. According to statistics, juvenile delinquency has accounted for 1/3 criminal cases issued every year in our country. Especially in the Chinese society is experiencing an unprecedented social transformation, Internet technology is increasingly mature, people's lives and the Internet is inseparable today. This kind of crime has the tendency of increasing intensity. Juvenile delinquency refers to a person who has reached the age of 14 and under 18 years of age who should be punished by penalty for violating the provisions of criminal law. By analyzing the present situation of juvenile delinquency in this period. Shape. Characteristics and development trends, and draw lessons from domestic and foreign theoretical research on juvenile delinquency, try to find out the specific causes of juvenile delinquency in China, and in view of these reasons from the law, society. Individual and other different angles of view to study the prevention and control of juvenile delinquency countermeasures. There are two main reasons for juvenile delinquency. From the individual reasons, including individual physiological characteristics and individual value factors, from the social reasons, the first is the changes of the family. This includes increasing numbers of migrant workers. The large increase in the number of divorces led to more divorced families and single-parent families and due to the intensification of social competition parents abandoned the education of their children in three aspects. Second is the development of social hatred. The polarization of wealth and status intensifies and expands the social hatred psychology, the economic interest is deprived or infringed causes the personal rights protection difficulty two aspects. Third, the network development brings the adverse influence. The negative information in the network has an impact on the psychology of minors and plays a role as an inducement to the traditional crime of minors. For the prevention and control of juvenile delinquency, the following countermeasures are put forward: for juvenile delinquency. It should be carried out from three aspects of legal prevention and control, social control and individual prevention and control, and should focus on prevention. For minors who commit crimes, criminal responsibility should not be investigated simply. They need to be corrected and treated for their bad psychological qualities.
