【摘要】：現(xiàn)代社會(huì)的職業(yè)道德與法律視野下的職業(yè)本位主義,是由職務(wù)本位思想主張和行為引發(fā)以權(quán)謀私、權(quán)力尋租、職務(wù)犯罪發(fā)生的表現(xiàn),也是國(guó)家權(quán)力部門化,部門權(quán)力個(gè)人化產(chǎn)生的深刻根源之一。立論職業(yè)本位主義的道德評(píng)析與法律遵守提示著,充分認(rèn)識(shí)職業(yè)本位主義和行業(yè)本位主義的危害性,要進(jìn)行集體主義的道德弘揚(yáng)與個(gè)體主義道德合理性產(chǎn)生的本位主義評(píng)析,進(jìn)而明確行業(yè)自律準(zhǔn)則是制約職業(yè)本位主義的道德與法治原則。在觀念和行為上實(shí)現(xiàn)職業(yè)道德"立法"與法律的遵守,要實(shí)現(xiàn)職業(yè)道德的"立法"與法律的德本原則回歸,從而建立行業(yè)反腐敗運(yùn)行機(jī)制,成為消解職業(yè)本位主義危害的基本途徑。
[Abstract]:The professional ethics of the modern society and the occupation orientation under the legal vision are the manifestation of the abuse of power for personal gain, the power seeking for rent and the duty crime caused by the thought and behavior of the job-based ideology, and it is also the division of the state power. One of the deep roots of the individualization of departmental power. The moral analysis and legal compliance of occupational ontology suggest that we should fully understand the harmfulness of professional and industry-oriented doctrine, and evaluate the moral development of collectivism and the localization of moral rationality of individualism. Furthermore, it is the moral and rule of law principle to make clear the profession self-discipline. In view of concept and behavior, we should realize the return of "legislation" of professional ethics and the principle of virtue of law in order to establish the mechanism of anti-corruption operation in the trade, so as to realize the "legislation" of professional ethics and abide by the law. It has become the basic way to eliminate the harm of occupational ontology.
