【摘要】：當代中國制度倫理建設的根本任務在于解決國家公權力的道德合法性問題,而法律又是現(xiàn)代法治中國國家公權力唯一合法來源。因此,讓具有中國特色法律倫理的現(xiàn)代"到場",用以構建當代中國法律的現(xiàn)代倫理品格,這應屬我國制度倫理建設的核心命題。而要完成當代中國法律倫理現(xiàn)代品格的塑造,根本問題在于如何讓當代中國法律具有道德以及具有什么樣的道德?無疑,在法律是民主的制度化與法律化的今天,只有以人民當家作主的民主方式實現(xiàn)對"國家公權力"的完全駕馭的問題,才能真正讓當代中國法律具有現(xiàn)代倫理品格。同時需指出的是,當代中國法律應具有的現(xiàn)代倫理品格,不是實現(xiàn)一般意義上的自由或平等,而是實現(xiàn)制度意義上的、以公共利益為基礎的、兼顧起點與結果平等的公平正義。
[Abstract]:The fundamental task of the construction of institutional ethics in contemporary China is to solve the problem of the moral legitimacy of national public power, and the law is the only legal source of the national public power in modern China.Therefore, it is the core proposition of the construction of system ethics in our country to let the modern "presence" of legal ethics with Chinese characteristics be used to construct the modern ethical character of contemporary Chinese law.To complete the shaping of the modern character of contemporary Chinese legal ethics, the fundamental problem lies in how to make contemporary Chinese law have morality and what kind of morality?There is no doubt that today, when the law is the institutionalization and legalization of democracy, only when the people are the democratic masters of the country can the issue of "national public power" be completely controlled, so that the contemporary Chinese law can truly have the modern ethical character.At the same time, it should be pointed out that the modern ethical character of contemporary Chinese law is not the realization of freedom or equality in general sense, but the realization of fairness and justice in the sense of system, based on public interest and taking into account the equality of starting point and result.
