【摘要】：引咎辭職是一項(xiàng)相對(duì)獨(dú)立,有著自身界限的制度,也是領(lǐng)導(dǎo)干部人事任免工作中問(wèn)題比較突出的部分.在黨內(nèi)法規(guī)、國(guó)家法律兩個(gè)規(guī)則系統(tǒng)中,引咎辭職問(wèn)責(zé)機(jī)制尚未得到全面認(rèn)識(shí)與應(yīng)有重視,程序制度方面的建構(gòu)更是受到忽視,導(dǎo)致實(shí)踐中辭職程序混亂、違規(guī)復(fù)出現(xiàn)象嚴(yán)重。從引咎辭職的開(kāi)始到終端,規(guī)范辭職前的申請(qǐng)程序、辭職時(shí)的決策程序、辭職后的任職復(fù)出程序,系統(tǒng)構(gòu)建引咎辭職制度的程序與方式是解決上述問(wèn)題的有效舉措。建立和完善引咎辭職及其復(fù)出的程序與方式,實(shí)現(xiàn)引咎辭職制度的程序之治,是對(duì)當(dāng)前落實(shí)領(lǐng)導(dǎo)責(zé)任、解決無(wú)人問(wèn)責(zé)問(wèn)題的最好回應(yīng),也是我國(guó)官員問(wèn)責(zé)機(jī)制走向規(guī)范化、法治化軌道的必經(jīng)路徑。
[Abstract]:Taking the blame and resigning is a relatively independent system with its own boundaries, and it is also a relatively prominent part of the work of appointing and removing leading cadres. In the system of inner-party laws and regulations and the two rules of the state law, The accountability mechanism of blame resignation has not been fully recognized and should be paid attention to, and the construction of procedural system has been ignored, which leads to the confusion of resignation procedure in practice and the serious phenomenon of illegal return, from the beginning of taking the blame to the end of resignation. To standardize the application procedure before resignation, the decision-making procedure upon resignation, and the post return procedure after resignation, It is an effective measure to solve the above problems to systematically construct the procedure and method of resignation system. To establish and perfect the procedure and method of resignation and its return, and to realize the governance of the procedure of resignation system, is the responsibility of the current implementation of the leadership. The best response to the problem of unattended accountability is also the necessary path for our officials' accountability mechanism to be standardized and legalized.
