【摘要】：十八屆三中全會(huì)后我國進(jìn)入深化改革階段,與此同時(shí),不作為現(xiàn)象屢禁不止,容錯(cuò)免責(zé)機(jī)制應(yīng)運(yùn)而生。當(dāng)前,容錯(cuò)免責(zé)機(jī)制尚未建立,因此,論文以容錯(cuò)機(jī)制建立的理論基礎(chǔ)為研究開端,通過與行政決策失誤、行政問責(zé)等制度的對比,明確容錯(cuò)免責(zé)機(jī)制的內(nèi)涵,同時(shí)探究容錯(cuò)免責(zé)機(jī)制的理論依據(jù)。其次對容錯(cuò)機(jī)制進(jìn)行實(shí)證研究分析。這一部分先以案例引出容錯(cuò)免責(zé)機(jī)制,次探究容錯(cuò)免責(zé)機(jī)制的發(fā)展進(jìn)程,進(jìn)而探尋容錯(cuò)機(jī)制實(shí)踐運(yùn)行效果。最后一部分講述完善容錯(cuò)免責(zé)機(jī)制的探索。探索三步走:首先確定容錯(cuò)免責(zé)的基本指導(dǎo)原則;其次理論體系的層面上進(jìn)行完善,確立包含免責(zé)主體、免責(zé)對象、免責(zé)條件、免責(zé)程序等基本要素的理論體系;最后實(shí)踐層面,在體制層面對這些要素協(xié)調(diào)、整合,最終實(shí)現(xiàn)容錯(cuò)免責(zé)機(jī)制的不斷優(yōu)化。總體上,文章主要運(yùn)用了實(shí)證分析、邏輯分析、比較分析的分析方法,文章對容錯(cuò)免責(zé)機(jī)制的研究分三部分進(jìn)行:明確概念——實(shí)證分析——完善。
[Abstract]:After the third Plenary session of the 18 CPC Central Committee, China has entered the stage of deepening reform. At the same time, the phenomenon of inaction is not stopped, and the fault-tolerant exemption mechanism emerges as the times require. At present, the fault-tolerant exemption mechanism has not been established, so, This paper begins with the theoretical foundation of fault-tolerant mechanism. By comparing with the system of administrative decision-making error and administrative accountability, the connotation of fault-tolerant exemption mechanism is clarified. At the same time, the theoretical basis of fault-tolerant exemption mechanism is explored. Secondly, the empirical analysis of fault-tolerant mechanism is carried out. In this part, the fault-tolerant exoneration mechanism is first brought out by case, and then the development process of fault-tolerant exemption mechanism is explored. In the last part, the author discusses how to perfect the fault-tolerant exemption mechanism. It explores three steps: first, the basic guiding principles of fault-tolerant exemption; secondly, improve the theoretical system, Establish the theoretical system including the basic elements such as the subject of exemption, the object of exemption, the condition of exemption, the procedure of exemption, etc. Finally, at the practical level, coordinate and integrate these elements at the institutional level, and finally realize the continuous optimization of the fault-tolerant exemption mechanism. The article mainly uses the empirical analysis, the logic analysis, the comparative analysis analysis method, the article carries on the research to the fault-tolerant exemption mechanism into three parts: clear concept-empirical analysis-perfect.
