【摘要】：黨的十八屆四中全會(huì)審議通過(guò)的《中共中央關(guān)于全面推進(jìn)依法治國(guó)若干重大問(wèn)題的決定》第一次明確地提出了"形成完善的黨內(nèi)法規(guī)體系"的要求,并將"黨內(nèi)法規(guī)體系"融入"中國(guó)特色社會(huì)主義法治體系"之中,使得"黨內(nèi)法規(guī)體系"建設(shè)成為全面推進(jìn)依法治國(guó)各項(xiàng)法治工作的重要目標(biāo)和任務(wù)。黨內(nèi)法規(guī)體系建設(shè)要注重實(shí)效性,應(yīng)當(dāng)從以下幾個(gè)方面來(lái)加強(qiáng)黨內(nèi)法規(guī)實(shí)效性機(jī)制建設(shè):要強(qiáng)化黨內(nèi)法規(guī)實(shí)施的組織保障體制建設(shè)。解決上下黨內(nèi)法規(guī)的效力等級(jí)關(guān)系問(wèn)題,根據(jù)黨領(lǐng)導(dǎo)立法工作的原則,通過(guò)及時(shí)修改《中國(guó)共產(chǎn)黨黨內(nèi)法規(guī)制定條例》的方式來(lái)賦予"設(shè)區(qū)的市"地方黨委制定黨內(nèi)法規(guī)的權(quán)力。依據(jù)科學(xué)和合理的分類(lèi)方法,建立比較科學(xué)和完善的"部門(mén)黨內(nèi)法規(guī)體系"。消除國(guó)家立法與黨內(nèi)法規(guī)兩張皮的問(wèn)題,確保黨內(nèi)法規(guī)簡(jiǎn)明扼要、實(shí)用高效。加強(qiáng)黨內(nèi)體系建設(shè)必須要從抓黨內(nèi)法規(guī)的規(guī)范體系的源頭出發(fā),確保黨內(nèi)法規(guī)真正在管黨治黨方面發(fā)揮自身的行為指引作用。
[Abstract]:The "decision of the CPC Central Committee on comprehensively promoting the Rule of Law on several important issues" adopted by the fourth Plenary session of the 18 CPC Central Committee for the first time clearly put forward the requirement of "forming a sound system of laws and regulations within the Party". And will "the inner-party laws and regulations system" into the "socialist rule of law system with Chinese characteristics", It makes the construction of "inner-party legal system" become an important goal and task of comprehensively promoting the rule of law work of governing the country according to law, and the construction of inner-party laws and regulations system should pay attention to the actual effect. We should strengthen the construction of the effective mechanism of inner-party laws and regulations from the following aspects: to strengthen the construction of the organizational guarantee system for the implementation of inner-party laws and regulations, to solve the problem of the hierarchical relationship of the effectiveness of the laws and regulations within the Party, and according to the principles of the Party's leading legislative work, Through timely revision of the regulations on the enactment of laws and regulations within the Party of the Communist Party of China, the local party committees of "districts and cities" are given the power to formulate laws and regulations within the Party, according to scientific and reasonable classification methods, Establish a more scientific and perfect system of "departmental laws and regulations", eliminate the problems of national legislation and inner-party laws and regulations, and ensure that inner-party laws and regulations are concise and concise. To strengthen the construction of the inner-party system, we must start from the source of the normative system of the inner-party laws and regulations, and ensure that the inner-party laws and regulations really play a guiding role in managing the Party and governing the Party.
