影視作品的著作權(quán)問題研究

【摘要】:我國著作權(quán)法上將“電影作品和以類似攝制電影的方法表現(xiàn)的作品”作為一種特殊類型的作品加以保護(hù),為我國的影視作品提供了法律保護(hù)的依據(jù)。影視作品作為一種綜合性的藝術(shù)作品,它的特殊之處體現(xiàn)在其匯聚了眾多勞動者的獨創(chuàng)性勞動。影視作品的著作權(quán)法律保護(hù)問題較為復(fù)雜,我國的影視作品保護(hù)在司法實踐中遇到許多難題,存在立法不夠完善,規(guī)范缺失等問題。我國影視作品的著作權(quán)保護(hù)制度在許多方面與國際水平還有一定差距。具體而言,我國影視作品的范圍過于狹窄,我國影視作品的定義已經(jīng)不能適應(yīng)科學(xué)技術(shù)的發(fā)展,同時缺乏一個在外延上大于“電影作品”的“影視作品”的概念,從而不合理的縮小了影視作品的范圍。在影視作品著作權(quán)的形成問題上存在很多有爭議的地方,審批制度是否是影視作品著作權(quán)產(chǎn)生的必要條件,,影視作品的獨創(chuàng)性標(biāo)準(zhǔn)這兩方面的問題在理論與實踐中都產(chǎn)生了較大的影響。關(guān)于影視作品的屬性,我國對于影視作品的屬性沒有做出規(guī)定,影視作品與基礎(chǔ)作品之間的關(guān)系沒有明確的法律指引。在影視作品的著作權(quán)歸屬方面,我國的保護(hù)模式也存在一些問題,比如制片人的確定,作者與著作權(quán)人的區(qū)分等。劇本屬于影視作品中“可單獨使用的作品”,但是在實際生活中劇本被隨意篡改、編劇的署名權(quán)被侵占這些問題屢見不鮮,影響了我國影視產(chǎn)業(yè)的健康發(fā)展。根據(jù)我國國情,借鑒國外可行模式完善我國著作權(quán)法,是促進(jìn)我國影視產(chǎn)業(yè)健康發(fā)展的必要基礎(chǔ)。完善我國影視作品法律保護(hù)制度可以從以下幾個方面著手,建立一個范疇更廣的“影視作品”概念,完善影視作品的定義;理清影視作品審批制度的性質(zhì),影視作品的獨創(chuàng)性標(biāo)準(zhǔn);明確影視作品與基礎(chǔ)作品之間的關(guān)系,將影視作品視為“特殊演繹作品”;保護(hù)影視作品著作權(quán)人和作者的合法權(quán)益,明確“制片人”標(biāo)準(zhǔn)與分類;加強對編劇與劇本的保護(hù),杜絕隨意篡改劇本和侵占編劇署名權(quán)的現(xiàn)象。
[Abstract]:As a special type of work, the copyright Law of our country protects "film works and works expressed in a similar way to film production" as a special type of work, which provides a legal basis for the protection of film and television works in our country. As a comprehensive work of art, film and television works are special in that they bring together the originality of many labors. The legal protection of the copyright of film and television works is more complicated. The protection of film and television works in our country meets many problems in judicial practice, such as imperfect legislation and lack of standardization. The copyright protection system of Chinese film and television works is still far from the international level in many aspects. In particular, the scope of film and television works in China is too narrow, the definition of film and television works in our country can no longer adapt to the development of science and technology, and at the same time, there is a lack of a concept of "film and television works" whose denotation is greater than "film works". As a result, the scope of film and television works is unreasonably narrowed. There are many controversies over the formation of copyright in film and television works. Is the examination and approval system a necessary condition for the production of copyright in film and television works? The originality standard of film and television works has had a great influence in theory and practice. About the attribute of the film and television works, our country has not made the stipulation to the attribute of the film and television work, the relation between the film and television work and the basic work has no clear legal guidance. In the aspect of copyright ownership of film and television works, there are also some problems in the mode of protection in China, such as the determination of producer, the distinction between author and copyright owner, and so on. The script belongs to "the work which can be used separately" in the film and television works, but in the actual life, the script is tampered with at will, the authorship of the screenwriter is encroached these problems are common occurrence, have affected the healthy development of the film and television industry of our country. According to the situation of our country, it is the necessary foundation to promote the healthy development of the film and television industry of our country to perfect the copyright law of our country by using the feasible mode of foreign countries for reference. To perfect the legal protection system of Chinese film and television works, we can start from the following aspects, establish a broader concept of "film and television works" and perfect the definition of film and television works; It clarifies the nature of the examination and approval system of the film and television works, the originality standard of the film and television works, clarifies the relationship between the film and television works and the basic works, and regards the film and television works as "special deductive works". To protect the legitimate rights and interests of copyright owners and authors of film and television works, to clarify the criteria and classification of "producers", to strengthen the protection of screenwriters and scripts, and to put an end to the phenomenon of tampering with the script and encroaching on the authorship of the writers.
