【摘要】：面對(duì)媒體融合帶來(lái)的制度失靈,德國(guó)報(bào)刊出版者產(chǎn)業(yè)驅(qū)動(dòng)立法,創(chuàng)設(shè)出獨(dú)立的"報(bào)刊出版者鄰接權(quán)"。就我國(guó)而言,在對(duì)待域外經(jīng)驗(yàn)的立場(chǎng)和方法上,學(xué)界往往僅注重對(duì)規(guī)則本身之評(píng)析,而忽視從制度生成層面結(jié)合一國(guó)特有的法制傳統(tǒng)和文化因素進(jìn)行比較法考察。通過(guò)分析可知,報(bào)刊出版者鄰接權(quán)是德國(guó)立法者針對(duì)媒體融合在本國(guó)的具體問(wèn)題,在對(duì)既有實(shí)定法律秩序和學(xué)理沿革進(jìn)行體系性考量的基礎(chǔ)上作出的破解德國(guó)相關(guān)制度失靈的對(duì)策。其立法行為本身的價(jià)值闡釋和邏輯論證應(yīng)為我國(guó)學(xué)界所重視,但其應(yīng)對(duì)制度失靈的具體策略因具有本土性,不宜為我國(guó)所采納。應(yīng)以媒體融合在我國(guó)的問(wèn)題表象為指引,結(jié)合既有規(guī)則體系和制度傳統(tǒng),思考我國(guó)相關(guān)制度失靈之內(nèi)在機(jī)理,完善對(duì)新媒體時(shí)代中報(bào)刊出版者權(quán)利的保護(hù)。
[Abstract]:In the face of the system failure brought by the media integration, German newspaper publishers' industry-driven legislation created an independent "newspaper publisher's neighboring right".As far as our country is concerned, in the position and method of dealing with the extraterritorial experience, the academic circles often only pay attention to the evaluation of the rules themselves, but neglect to combine the legal tradition and cultural factors of a country from the system generation level to carry on the comparative law investigation.Through the analysis, we can see that the neighbor right of newspaper publisher is the specific problem that German legislator aims at media amalgamation in the country.Based on the systematic consideration of the established legal order and theoretical evolution, the countermeasures to break the failure of the German system are put forward.The value interpretation and logical argumentation of its legislative act itself should be attached importance to by the academic circles of our country, but the concrete strategy to deal with the system failure should not be adopted by our country because of its native nature.We should take the problem appearance of media fusion in our country as the guide, combine the existing rule system and system tradition, think about the mechanism within the failure of the relevant system of our country, perfect the protection of the press publisher's right in the new media age.
