【摘要】：隨著網(wǎng)絡(luò)技術(shù)的飛速發(fā)展,互聯(lián)網(wǎng)這個(gè)新科技工具開始走近人們的工作、學(xué)習(xí)和生活。網(wǎng)絡(luò)技術(shù)給人們生活帶來便利的同時(shí),也極大地沖擊了現(xiàn)有的著作權(quán)保護(hù)體系,由此在審判實(shí)踐中產(chǎn)生了許多新的問題。網(wǎng)絡(luò)海量信息共享并可低成本復(fù)制的特點(diǎn)使得侵犯網(wǎng)絡(luò)著作權(quán)的行為普遍,嚴(yán)重侵害了著作權(quán)人的利益,這使得對(duì)網(wǎng)絡(luò)空間的權(quán)利保護(hù)已經(jīng)迫在眉睫。 本文將從網(wǎng)絡(luò)著作權(quán)方面對(duì)網(wǎng)絡(luò)空間里存在的侵權(quán)問題進(jìn)行初步探析。本文整體分為四個(gè)部分,第一部分主要闡述網(wǎng)絡(luò)著作權(quán)的基礎(chǔ)理論,包括著作權(quán)和網(wǎng)絡(luò)著作權(quán)的定義和特征；第二部分主要闡述網(wǎng)絡(luò)著作權(quán)的侵權(quán)行為,包括侵權(quán)行為及其特點(diǎn)；第三部分主要闡述網(wǎng)絡(luò)著作權(quán)的損害賠償原則；第四部分主要闡述對(duì)于處理網(wǎng)絡(luò)著作權(quán)侵權(quán)案件的若干建議,包括完善現(xiàn)有的網(wǎng)絡(luò)著作權(quán)法律制度、統(tǒng)一審判中的執(zhí)法尺度及完善證據(jù)保全制度。
[Abstract]:With the rapid development of network technology, the Internet, a new technological tool, is beginning to approach people's work, study and life.While the network technology brings convenience to people's life, it also greatly impacts the existing copyright protection system, which brings about many new problems in the trial practice.The characteristics of network mass information sharing and low cost reproduction make the infringement of network copyright widespread and seriously encroach on the interests of copyright owners. This makes the protection of rights in cyberspace imminent.This article will analyze the infringement problem in cyberspace from the aspect of network copyright.This paper is divided into four parts as a whole. The first part mainly expounds the basic theory of network copyright, including the definition and characteristics of copyright and network copyright, the second part mainly expounds the infringement of network copyright.Including tort and its characteristics; the third part mainly expounds the principle of network copyright damage compensation; the fourth part mainly expounds some suggestions for dealing with network copyright infringement cases, including improving the existing legal system of network copyright.Unify the law enforcement standard in the trial and perfect the evidence preservation system.
