民間文藝作品演繹的法律規(guī)制

【摘要】:本文研究民間文藝作品演繹行為的法律規(guī)制問題。筆者在綜合相關(guān)研究現(xiàn)狀和立法實(shí)踐的基礎(chǔ)上,明確了“民間文藝作品”概念的內(nèi)涵與外延,,并論證了以著作權(quán)法規(guī)制民間文學(xué)藝術(shù)作品演繹行為的可能。全文通過理論分析和案例研究兩種模式探究了演繹民間文藝作品的權(quán)利邊界問題,最后得出結(jié)論:在保護(hù)專有權(quán)人基本權(quán)利的前提下,應(yīng)當(dāng)區(qū)分演繹主體規(guī)制其演繹行為。 在篇章結(jié)構(gòu)上,本文的緒論部分先闡述了相關(guān)研究的背景以及通過著作權(quán)規(guī)制民間文藝作品演繹行為的必要性,其后羅列了涉及民間文藝作品演繹行為的主要立法實(shí)踐和國內(nèi)一些學(xué)者較有代表性的觀點(diǎn)。本文第一章梳理了民間文學(xué)藝術(shù)在國際傳統(tǒng)和我國語境中的各自涵義,并分析了演繹行為對(duì)于民間文學(xué)藝術(shù)的重要意義。在第二章的第一節(jié)中,本文從演繹民間文藝作品的法律關(guān)系框架出發(fā),分別界定了受著作權(quán)法規(guī)制的演繹客體、具有集合特性的權(quán)利主體以及單一演繹關(guān)系中的基本權(quán)利義務(wù)。本章第二節(jié)則分別以特殊演繹主體和特殊演繹糾紛為視角,通過司法實(shí)踐中的案例分析了民間文藝作品的演繹行為的權(quán)利邊界問題,之后在第三節(jié)中論證了民間文藝作品合理使用的本質(zhì)在于利益平衡和利益交換的問題。筆者在第三章中進(jìn)一步提出在民間文藝作品演繹法律關(guān)系中作為“底線”的基本演繹原則。在此基礎(chǔ)上,應(yīng)當(dāng)尊重現(xiàn)實(shí)狀況區(qū)分不同的演繹主體設(shè)定義務(wù),使得民間文藝作品著作權(quán)法保護(hù)體系的完善既能繼續(xù)推動(dòng)民間文藝作品的弘揚(yáng)和發(fā)展,又不至威脅到社會(huì)公眾的創(chuàng)作熱情。
[Abstract]:This paper studies the legal regulation of deductive behavior in folk literature and art works.On the basis of synthesizing the current situation of relevant research and legislative practice, the author clarifies the connotation and extension of the concept of "folk literature and art works", and demonstrates the possibility of regulating the deductive behavior of folk literature and art works by copyright law.Through theoretical analysis and case study, this paper probes into the boundary of the right to deduce folk works of literature and art, and finally draws a conclusion that under the premise of protecting the basic rights of the exclusive owner, the deductive subject should be distinguished to regulate its deductive behavior.In the structure of the text, the introduction of this paper first expounds the background of the relevant research and the necessity of regulating the deductive behavior of folk literary works through copyright.After that, it lists the main legislative practice concerning the deduction of folk literature and art works and the representative views of some domestic scholars.The first chapter combs the respective meanings of folklore in international tradition and Chinese context, and analyzes the significance of deductive behavior to folklore.In the first section of the second chapter, starting from the legal relationship framework of deducing folk literature and art works, this paper defines the deductive object of copyright regulation system, the subject of rights with collective characteristics and the basic rights and obligations in a single deductive relationship.In the second section of this chapter, from the perspective of special deductive subject and special deductive dispute, the author analyzes the right boundary of the deductive behavior of folk literature and art works through the case of judicial practice.The third section demonstrates that the essence of the rational use of folk literature and art works lies in the balance of interests and the exchange of interests.In the third chapter, the author further puts forward the basic deductive principle of "bottom line" in deductive legal relation of folk literature and art works.On this basis, we should respect the reality and distinguish the obligations of different deductive subjects, so that the improvement of the copyright protection system of folk literary and artistic works can continue to promote the promotion and development of folk literary and artistic works.It does not threaten the creative enthusiasm of the public.
