【摘要】：我國《著作權(quán)法(修訂草案)》新增了追續(xù)權(quán),并適用于美術(shù)、攝影作品的原件以及文字和音樂作品的手稿。但是,追續(xù)權(quán)制度的立法宗旨在于維持著作權(quán)人和作品購買者間的利益平衡,以保障著作權(quán)人獲得與其付出相應(yīng)的回報,實現(xiàn)社會公平。從此法理基礎(chǔ)出發(fā)進(jìn)行衡量,美術(shù)和攝影作品原件應(yīng)當(dāng)納入追續(xù)權(quán)客體,文字和音樂作品的手稿則應(yīng)排除在外。一些主要國家的立法和國際公約印證了這一點。此外,結(jié)合我國藝術(shù)品的創(chuàng)作和流通實踐,著作權(quán)法也應(yīng)為實用藝術(shù)作品留下追續(xù)權(quán)制度的適用空間。
[Abstract]:The copyright Law of China (revised draft) has added a new right of renewal and applies to the original works of art, photography and manuscripts of written and musical works. The aim of the system is to maintain the balance of interests between the copyright owner and the buyer of the work, so as to ensure that the copyright owner gets the corresponding return and realizes the social justice. The original works of art and photography should be included in the object of the right of continuation, while manuscripts of written and musical works should be excluded. This is confirmed by the legislation and international conventions of some major countries. In addition, combined with the practice of the creation and circulation of works of art in China, Copyright law should also leave space for the application of the system of the right of continuation of practical works of art.
