【摘要】：隨著信息網(wǎng)絡(luò)技術(shù)的發(fā)展,越來越多的搜索引擎運營商發(fā)現(xiàn)基于信息網(wǎng)絡(luò)技術(shù)的具體應(yīng)用很容易侵犯著作權(quán)人的著作權(quán)以及網(wǎng)絡(luò)信息傳播權(quán),互聯(lián)網(wǎng)業(yè)內(nèi)人士往往抱怨這方面法律的滯后性及其同新興技術(shù)的格格不入。2007年12月剛剛在北京市高級人民法院終審結(jié)案、塵埃落定的國際唱片業(yè)協(xié)會訴中文雅虎侵犯音樂著作權(quán)和網(wǎng)絡(luò)信息傳播權(quán)一案,探討在目前現(xiàn)有中國法律的框架下,搜索引擎運營商在何種狀況下會因為其使用技術(shù)方案而承擔侵權(quán)法律責任。
[Abstract]:With the development of information network technology, more and more search engine operators find that the specific application based on information network technology can easily infringe the copyright of copyright owner and the right of network information dissemination. Internet insiders often complain about the lag of laws in this area and their incompatibility with emerging technologies. The case was closed in December 2007 at the Beijing Municipal higher people's Court. The settled case of the International Phonographic Industry Association v. Yahoo! in Chinese infringes on music copyright and the right to disseminate information on the Internet, and probes into the current framework of Chinese law. Under what circumstances will search engine operators assume tort legal liability because of their use of technical solutions.
