【摘要】：舟山市普陀區(qū)房屋用途臨時變更現(xiàn)象非常普遍,在老城區(qū)中尤甚。適時適度的臨時變更不僅能節(jié)約城市資源、快速促進(jìn)城市更新,更能為存量規(guī)劃的發(fā)展提供新的思路。然而,普陀區(qū)已審批的變更案例研究表明,目前臨時變更管理中存在變更隨意、審批不嚴(yán)、有礙民生及資源浪費等主要問題。借鑒國內(nèi)外相關(guān)管理經(jīng)驗,討論普陀區(qū)臨時變更管理的政策設(shè)計。指出,把房屋用途變更管理作為法定控規(guī)彈性的一項重要補充,有利于為房屋用途臨時變更提供法定依據(jù),對推動我國控規(guī)編制理念的轉(zhuǎn)型和存量規(guī)劃的發(fā)展具有積極的意義。
[Abstract]:Temporary changes in housing use in Putuo District, Zhoushan City, are very common, especially in old urban areas. Timely and moderate temporary change can not only save urban resources, promote urban renewal quickly, but also provide new ideas for the development of stock planning. However, the case studies on the changes approved in Putuo District show that there are some major problems in the temporary change management, such as arbitrary changes, lax approval, obstruction of people's livelihood and waste of resources, and so on. This paper discusses the policy design of temporary change management in Putuo District based on relevant management experience at home and abroad. It is pointed out that taking the management of house use change as an important supplement to the flexibility of statutory control rules is beneficial to provide the legal basis for the temporary change of house use and has a positive significance in promoting the transformation of the concept of control and planning and the development of stock planning in China.
